   بررسی تاثیر رابطۀ ابوت بر تحقق جرایم علیه اموال و صدور حکم تعزیری

چکیده    بنابر نظر فقهای شیعه چنانچه سارق، پدر یا جد پدری مالباخته باشد امکان اجرای حد فراهم نیست. در این صورت آیا علاوه بر حد، مجازات تعزیری مرتکب نیز ناممکن می‌گردد یا خیر؟ در این مقاله به روش توصیفی‌تحلیلی سعی در اثبات این موضوع به عنوان یک حکم فقهی معتبر شده است که امکان اعمال مجازات و صدور حکم تعزیری وجود ندارد و نمی‌توان به چنین مرتکبی عنوان سارق را بار نمود علاوه بر این با توجه به ادله و مستندات این نظر قائل به این هستیم که علاوه بر عنوان سرقت در خصوص سایر جرایم علیه اموال نیز همین حکم جاری می‌باشد و با توجه به وضعیت تقنینی موجود امکان بکارگیری این نظریه در مقام اجرای قوانین نیز وجود دارد.

   analyzing the impact of father-son relationship on crimes against property and the issuance of discretionary judgment (ḥukm-i taʿzīrī)

Abstract    according to the shīʿa jurisconsults, the execution of punishment (ḥadd) cannot be applied if the thief is the father or paternal grandfather of the victim. the question is whether in this case it is neither possible to implement the discretionary punishment (taʿzīrī) as well as the punishment of ḥadd. adopting the descriptive-analytical method, the current study attempts to demonstrate that issuing discretionary judgment is not possible, and that such an offender cannot be labeled as a thief. moreover, according to the evidence and documentations, this ruling applies not only to theft, but also to other crimes against property. given the current legislative status, it is possible to employ this theory in the implementation of law as well.
