پژوهشی در اسناد و اعتبار حدیث رفع

حدیث رفع را می توان یکی از مهمترین احادیثی دانست که در اصول فقه برای اثبات اصل برائت شرعی بدان استناد شده و در فقه به کار گرفته می‌شود. برخی از بزرگان معاصر اشکالاتی را در اعتبار سندی این حدیث و امکان استناد به آن مطرح نموده اند و مباحثاتی در این باره میان فق‌ها و اصولیان شکل گرفته است. ما در این مقاله ضمن طرح و نقد و بررسی دیدگاه‌های بزرگان کوشیده‌ایم که با تتبع در متون و جمع آوری و مقارنه شواهد، اعتبار سندی احادیثی که بر رفع ما لا یعلمون مشتمل است را بر اساس مبانی مختلف در اعتبار اخبار و اسناد نشان دهیم. در این راستا مسیر‌هایی برای توثیق عام و خاص راویان و وثوق به صدور مضمون رفع ما لا یعلمون با توجه به استفاضه و کثرت نقل را پی جسته‌ایم.

a research on the documents and validity of hadith raf~

raf~ hadith is one of the most important hadiths that is cited in the principles of jurisprudence to prove the principle of bera’at shar’ee and has a wide application in jurisprudence. some contemporary jurists have raised some problems regarding the documentary validity of this hadith and the ability to cite it.                                                                                                                                      in this essay, by using the descriptive and analytical method, while criticizing and reviewing the views, we try to prove the documentary validity of the quotes that contain the phrase &rofe’a ma la ya’almun&, based on different bases in the validity of traditions and documents. in this regard, we have opened paths for the general and specific verification of the narrators and trust in issuing the theme of &rofe’a ma la ya’almun& due to the reliability and multiplicity of narrations
