تاثیر وجود یا فقدان قید «فی الاسلام» در روایت «لا ضرر و لا ضرار» در استنباط مسائل فقهی

یکی از مسائل روایتِ «لَاضَرَرَ وَ لَاضِرارَ»، طرح و بررسیِ تاثیرِ وجود یا فقدان عبارتِ «فِی الْاِسْلَامِ» در استنباط مسائل فقهیِ آن است. در این خصوص، پژوهش جامع و مستقلی انجام نگرفته است و جستار حاضر درصدد انجام این کار و پاسخ‌گویی به این سوال اصلی و سوالات فرعی مرتبط با آن به‌روش تحلیلی‌استنادی و کتابخانه‌ای است بدین‌گونه که وجود یا فقدان عبارتِ فِی الْاِسْلَامِ تاثیر مستقیم در استنباط مسائل فقهیِ این روایت دارد. این نوشتار، اثر وجود عبارت «فِی الْاِسْلَامِ» در روایت «لَاضَرَرَ وَ لَاضِرارَ» را در تاسیسی‌بودنِ ماهیت حکم مستفاد از روایت و نیز نفی ضرر از روابط حقوقی ضرری بین مردم و نیز انطباق بر احکام شرعی ضرری پی‌جویی کرده است. چنین حکم ضرری در مکاتب حقوقیِ بشری بی‌سابقه است.
