تحلیل انتقادی مشروعیت عقد بر صغیره به‌ منظور ایجاد محرمیت

یکی از مباحث مهم و کاربردی در فقه امامیه، بحث از حیله‌های شرعی؛ ازجمله عقد موقت بر دختر صغیرهٔ غیرقابل التذاذ یا شیرخوار به‌منظور ایجاد محرمیت با مادر اوست، آن هم بدون قصد جدی بر ازدواج نه از سوی ولی صغیره و نه از سوی کسی که می‌خواهد با مادر آن صغیره محرم شود. دراین‌باره دیدگاه‌هایی از سوی فقها مطرح شده است. مشهور فقها آن را صحیح و جایز و دارای اثر دانسته و فتوا به تحقق محرمیت داده‌اند و به این‌خاطر در میان متدینان رواج دارد و به‌راحتی انجام می‌شود، اما برخی از فقها با تردید در صحت آن، چنین عقدی را محل اشکال دانسته و حکم به عدم‌تحقق محرمیت کرده‌اند. نگارنده به‌روش توصیفی‌تحلیلی و با استفاده از ابزار کتابخانه‌ای به‌بررسی این مسئله پرداخته و با تحلیل ادله و بیان اشکالات دیدگاه مشهور به این نتیجه دست یافته است که به‌کار‌گیری چنین حیله‌ای غیرصحیح و تحقق محرمیت با آن با تردید جدی و اساسی مواجه است.
