تبیین جایگاه قاعده فقهیِ لاحرج در شهرسازی اسلامی

قاعدۀ لاحرج از جمله قواعد فقهیِ تسهیل­کننده در فقه اسلامی و ازجمله زمینه‌های کاربردی آن، مسائل زندگی شهری است. حرج و مشقت در شهر می‌تواند در گونه‌های جسمانی، روحی و روانی، اجتماعی و مالی جلوه‌گر شود. مطالعهٔ این قاعده در زندگی شهری، مسائلی همچون صعوبت و دشواری در رفت‌وآمد به‌دلیل مسافت‌های زیاد، عدم پیاده‌مداری، اختلال در ترافیک، کمبود حمل‌ونقل عمومی، دشواری استفادهٔ فضا‌ها برای افراد کم‌توان و معلولان، آلودگی صوتی، ازدحام، سیلاب‌های شهری را شامل می‌شود. این جستار درپی تبیین ابعاد و مصادیق قاعدهٔ لاحرج در زندگی شهری و جستجوی راهکار‌های معطوف به شهرسازی اسلامی است که با روش تحلیل محتوای متن و استدلال منطقی با رویکرد مطالعه‌ بین‌رشته‌ای و با به‌کارگیری شیوه‌ کتابخانه‌ای و اسنادی انجام شده است. نتایج پژوهش نشان می‌دهد که در شهر اسلامی بایستی زمینهٔ عمل به احکام الهی فراهم شود و برنامه‌ریزی‌‌ها و اقدامات آسایش و آرامش مسلمانان را فراهم کند. در شهر اسلامی حرج‌های شهری باید در فرایند برنامه‌ریزی، طراحی و مدیریت شهری پیش‌بینی و مدنظر قرار گیرند. کاربست این قاعده می‌تواند در تسهیل رفت‌وآمد به‌ویژه برای اقشار کم‌توان، کارایی و راحتی استفاده از مبلمان شهری، فضا‌های عبوری، دسترسی و توقف و... نتایجی دربرداشته باشد. نیز سهولت و رفاه مذکور باید برای تمامی سنین، گروه‌های اجتماعی نظیر زنان، کودکان، سالخوردگان و... دستاورد مشخصی دربرداشته باشد.

Explaining the position of the jurisprudential rule of la-haraj ( the fall of unbearable hard task according to habit) in Islamic urban planning

The rule of laharaj is one of the facilitative jurisprudence rules in Islamic jurisprudence and one of its practical fields is urban life issues. Harassment and hardship in the city can manifest in physical, mental, social and financial forms. The study of this rule in urban life includes issues such as  difficulty in commuting due to long distances, lack of pedestrian orientation, traffic disruption, lack of public transportation, difficulty of using spaces for disabled people, noise pollution, congestion, urban floods. The results of the research show that in the Islamic city, the ground for the implementation of divine commandments should be provided and the planning and measures should provide the comfort and peace of Muslims. In the Islamic city, urban problems should be anticipated and taken into account in the process of urban planning, design and management. The application of this rule can have results in facilitating commuting, especially for the underprivileged, the efficiency and comfort of using urban furniture, transit spaces, access and stopping, etc. Also, the ease and wellbeing mentioned should be a specific achievement for all ages, social groups such as women, children, elderly, etc.
