بررسی فقهی حکم رانت‌خواری با استناد به قاعدۀ لاضرر

مقالۀ حاضر به روش تحلیلی‌توصیفی و با استناد به قاعدۀ لاضرر، حکم تکلیفی و وضعی رانت‌خواری را دنبال می‌کند. قاعدۀ لاضرر از قواعد مسلّم فقهی، دلیل اثبات حرمت رانت‌خواری در مواردی است که منجر به تضییع حقوق دیگران شود. ضمن اینکه باتوجه‌به جریان قاعدۀ لاضرر در عدمیات و همچنین تنقیح مناط و اتکا به بنای عقلا در استدلال به قاعدۀ لاضرر، شخص رانت‌خوار ملزم به جبران خسارت بوده و به‌سبب محروم‌کردن دیگران از حق خود، ضامن ضررهایی است که متوجه آنان کرده‌ است. البته در برخی مصادیقِ رانت سیاسی و اطلاعاتی که تضییع حقی صورت نگیرد، نمی‌توان با استناد به این قاعده قائل به حرمت رانت‌خواری شد.

Jurisprudential study of the sentence of rent-seeking with reference to no harm(la zarrar) rule

The present article follows the mandatory and status rule of rentseeking by descriptiveanalytical method and with reference to the noharm (la zarar) rule. The noharm rule which is one of the indisputable rules of jurisprudence, is the reason for proving the sanctity of rentseeking in cases that lead to the violation of the rights of others. At the same time, due to application of the noharm rule in nonexistence, as well as the denunciation of criterion (tanghih e manat) and reliance on the wise’s procedure (bana e oghala) in arguing through the noharm rule , since the rentseeker has deprived others of their entitlement he is obliged to compensate and guarantee the damages he has inflicted on them. Of course, in some cases of political and information rent that no rights are violated, rentseeking cannot be considered haram based on this rule.
