مقتضای اصل عملی به هنگام شکّ در نفسی و غیری بودن «واجب»

در خصوص اجرای اصل عملی– به هنگام شکّ در نفسی بودن و غیری بودن یک واجب میان اصولیان اختلاف نظر وجود داشته و دیدگاه‌های گوناگونی مطرح است تا جایی که آخوند خراسانی تقسیم بندی دوگانه‌ای را ابداع کرده و سرانجام مرحوم نائینی، تقسیم بندی سه‌گانه‌ای را مطرح نموده که مورد پذیرش اکثریت علما قرار گرفته است. لیکن در این تحقیق، به تقسیم بندی سه‌گانه جدیدی می‌رسیم که در آرای علما مسبوق نبوده و به‌گونه‌ای حاصل تلفیق تقسیمی است که خوئی و نائینی ارائه کرده‌اند.

Expedient of the Practical Principle at the Time of Doubt whether an “Obligatory” is Nafsī (for itself) or ghayrī (for another)

There has been disagreement among uṣūlīs concerning the execution of the practical principle – at the time of doubt whether an obligatory is nafsī (for itself) or ghayrī (for another) – and various viewpoints are brought up, to the extent that Ākhūnd Khurasanī has devised a double division and finally, the late Nā’īnī devised a triple division that has been approved by the majority of scholars. In this research, however, we have achieved a new triple division, which has been unprecedented in the opinions of the early scholars and is, in a way, a combination of the divisions presented by Khū’ī and Nā’īnī.
