تبیینی از اعتبارسنجی در اندیشه اسلامی: میان کنشی فقهی اخلاقی

با پیشرفت تکنولوژی و نیاز به سامانه ها و نهادهای جدید، بر قانونگذاران لازم است متناسب با نیازهای روز، اقدام به قانونگذاری در زمینه استفاده از این تکنولوژی ها نمایند، تا سواستفاده مجرمین از تکنولوژی تا حد ممکن کاسته شود. یکی از مباحثی که جهان با آن در تقابل است، مفاسد اقتصادی است. مفاسدی چون پولشویی که نیازمند مقابله و راهکارهای قانونی می‌باشد. کشورها در راستای مبارزه با مفاسد اخلاقی و کاهش درگیری های حقوقی در این زمینه به استفاده از اعتبارسنجی مدنی روی آورده اند. در ایران، این طرح به صورت قانونی جا باز نکرده است و تنها موسسات مالی و اعتباری و بانک‌ها موظفند که نسبت به اعتبارسنجی مشتریان خود اقدام نمایند، لیکن اعتبارسنجی مدنی محدود به امور مالی نبوده و طیف وسیعی از مباحث را در خود جای داده است. موضوع این پژوهش جایگاه و نقش اعتبارسنجی مدنی در قواعد اخلاقی است. اخلاق، دستورالعمل برای زندگی ارزشمند و متعالی را پیش روی ما قرار می دهد. برای آنکه انسان به کمال لایق خود برسد باید این جنبه وجودی را نیز در خود شکوفا سازد؛ این کمال بواسطه عمل به یکسری قواعد اخلاقی میسر است ؛ در همه جوامع و اعصار، افراد روابط خود را در چارچوب قواعد و قوانینی تنظیم می کرده اند که عمده این ضوابط اخلاقی بوده اند. اخلاق از نیکی و زشتی یا شایستگی و ناشایستگی سخن می گوید. پژوهش حاضر به بررسی جایگاه اعتبارسنجی در قواعد اخلاقی خواهد پرداخت که چه تاثیری روی هم خواهند داشت.

with the advancement of technology and the need for new systems and institutions, legislators need to legislate in accordance with the needs of the day, to legislate on the use of these technologies to reduce the abuse of this technology as much as possible. one of the issues facing the world is economic corruption. corruption such as money laundering, which requires legal action and solutions. countries have resorted to civic accreditation to combat moral corruption and reduce legal conflicts. in iran, the scheme is still not legal, and financial and credit institutions and banks are required to provide credit to their customers, which is not limited to finance and has a wide range of issues.the subject of this research is the place and role of civic validation in ethical rules. ethics provides us with guidelines for a valuable and transcendent life.it lies in human beings and in order for human beings to reach their worthy perfection, they must also flourish this aspect of existence; and this perfection is possible by practicing a set of moral rules; in all societies and eras, individuals have regulated their relationships within the framework of rules and regulations that have been the basis of these ethical rules. morality speaks of goodness and ugliness or merit and indecency. the present study will examine the place of validation in ethical rules and what effect they will have on each other.
