توصیه اخلاقی و لزوم تقدم حق عمومی در حیازت مباحات و معادن عامه

اخلاق مقوله‌ای است که همیشه و در همه جا حضور داشته و سیلان آن شرط غیر مذکور در همه فعالیت‌های بشری است؛ به همین نسبت در حوزه قراردادها و حق مالکیت و اعمال حقوق خصوصی هم اخلاق حضوری پر رنگ دارد و توصیه‌های جدی دارد. بنابراین در زمینه رفتارهای حقوقی که به حوزه عمومی، حقوقی و حق حاکمیت و عموم افراد مرتبط است. طبیعتاً اخلاق حضور و توصیه دارد. در پژوهش پیش رو در زمینه بهره برداری افراد از مباحات و حیازت از آن‌ها و نیز معادن عامه که طبیعتاً طلاقی زیادی با حقوق عمومی افراد دارد و توصیه‌های اخلاقی محدودیت‌هایی را ایجاد خواهد کرد، به بررسی پرداخته شده و توصیه‌های اخلاقی که محدودیت‌هایی برای حقوق خصوصی و حق مالکیت افراد در حوزه‌ی خصوصی ایجاد می‌کند را با روش توصیفی تحلیل و شیوه و ابزاری کتابخانه‌ای را به بحث گذاشته است و به نتایج بدیع و خوبی در این خصوص دست یازیده و به سوالات و ابهامات چندی در این زمینه پاسخگو بوده است و منتج به این حاصل گردیده که افراد در بهره‌برداری از حیازت مباحات و نیز معادن عامه مطلق العنان و آزاد نبوده بلکه محدودیت‌های چندی از جمله در حوزه توصیه‌های اخلاقی را دارند.
