مفهوم، مبنا و موقعیت رفتار مجرمانه جرائم علیه اموال و مالکیت

اندیشمندان حقوقی در تحلیل عناصر سه‌گانه جرائم و به‌طور مشخص عنصر مادی جرم، « رفتار مجرمانه» را یکی از چند جزء رکن مادی برمی‌شمارند. مسائل، موضوعات و دریافت‌های مختلفی در این باره مطرح است . در خصوص رفتار مجرمانه در «جرائم علیه اموال و مالکیت» ابهامات و چالش‌های مطروحه، هم از نقطه ‌نظر کمی و هم از لحاظ پیچیدگی‌های خاص حقوقی، برجسته‌تر هستند. از این رو در این نوشتار تلاش می‌شود تا با هدف تبیین و شناخت « مفهوم، مبنا و موقعیت جزء رفتار مجرمانه از عنصر مادی جرائم علیه اموال و مالکیت» ، به روش توصیفی تحلیلی و با بهره‌گیری از منابع کتابخانه‌ای و متون نوشتاری و نظرات و دیدگاه‌های مختلف مطرح‌شده، مسائل و موضوعات مدنظر در این باره مطرح و مورد تجزیه‌وتحلیل قرار گیرند. در همین راستا این نوشتار در سه بخشِ«مفهوم شناسی»، «مبانی نظری» و«موقعیت» رفتار مجرمانه از عنصر مادی جرائم علیه اموال و مالکیت به رشته تحریر در آمده است. نتایج تحقیقات انجام شده در این خصوص گویای این است که اولاً در جرائم علیه اموال و مالکیت، مفهوم رفتار مجرمانه مثبت و منفی، توامان در بردارنده معنای این جزء هستند. ثانیاً نظریه «فعل پایه » جرائم را با همه تفاوت و تنوعی که دارند واجد جزیی مشترک با عنوان «حرکت بدنی ارادی» می‌داند و جرائم علیه اموال و مالکیت نیز از این قاعده مستثنی نیستند، بااین‌حال وقوع غالب جرائم علیه اموال و مالکیت از طریق ترک فعل نیز قابل تحقق بوده و اگر به دید عرفی به رابطه علیّت نگریسته شود، می‌توان تارک را در اغلب جرائم علیه اموال و مالکیت، مجرم به شمار آورد.
