واکاوی مفهوم سرمایه در حقوق بین ‏الملل سرمایه‏گذاری با تاکید بر اموال فکری (مطالعۀ تطبیقی رویکرد جهان‏ شمول و ایران)

مفهوم سرمایه و قلمرو آن در نظام حقوقی حاکم بر معاهدات سرمایه‏گذاری جایگاه ویژه‏ای دارد؛ لذا یکی از ابعاد نقش و جایگاه حقوق مالکیت فکری در حقوق بین‏الملل سرمایه‏گذاری و شاید مهم‏ترین آن، شمول مفهوم سرمایه بر اموال فکری و قلمرو حمایتی در این زمینه است. این امر در تحولات تاریخی وضعیتی یکسان ندارد؛ بنابراین، تاریخچۀ معاهدات سرمایه‏گذاری و به تبع آن، تحول تاریخی مفهوم سرمایه و نیز شمول آن بر حقوق مالکیت فکری را در دو دورۀ اصلیِ قبل و بعد از سال 1960 مقارن ایجاد شاخۀ حقوق بین‏الملل سرمایه‏گذاری به‏طور مستقل مورد مطالعه قرار داده‏ و سپس به تحلیل مفهوم سرمایه در این شاخۀ حقوقی با تاکید بر اموال فکری پرداخته‏ایم. مطابق نتایج تحقیق حاضر در سطح جهانی، رویکرد موسع در خصوص مفهوم سرمایه و حمایت از حقوق مالکیت فکری در معاهدات مرتبط با سرمایه‏گذاری بین‏المللی حاکم بوده، که بر مبنای اثر فراگیر معاهدات، ناشی از شروط حمایتی آنها، به‏ویژه شرط دولت دارای بیشترین امتیاز، به‏تدریج به قاعدۀ فراگیر مبدل شده، حتی موجب ارتقای استانداردهای متعارف حمایتی در زمینۀ مفهوم سرمایه و حقوق مالکیت فکری می‏شود. لذا اصلاح رویۀ اتخاذی کشورهای درحال توسعه، به‏ویژه اعضای سازمان تجارت جهانی، ضروری است.در ایران رویۀ اتخاذی در موافقت‏نامه‏های سرمایه‏گذاری دوجانبه، اتخاذ رویکرد موسع در مفهوم سرمایه و همچنین حمایت از حقوق مالکیت فکری به‏عنوان سرمایه است. این درحالی است که نباید در این راه افراط نمود و نمی‏توان وضعیت، نحوه و قلمرو حمایت از سرمایه و حقوق مالکیت فکری را برای تمامی کشورها و در همۀ حوزه‏های سرمایه‏گذاری یکسان دانست؛ به‏ویژه در خصوص کشورهایی همچون ایران که حتی الزامات بین‏المللی موافقت‏نامۀ تریپس را نپذیرفته‏اند.

an analysis of the concept of investment in international investment law with emphasis on intellectual property (a comparative study of the universal approach and iran)

the concept of investment and its scope has a specific status in the legal system governed by investment agreements. therefore, one of the aspects of the role and status of intellectual property in international investment law, and perhaps the most important, is the inclusion of the concept of investment and the protective scope. this does not same status in historic evolutions, therefore history of investment agreements and accordingly historic evolution of the concept of investment and its inclusion on intellectual property should be studied in two main periods, before 1960 and the period after this date, independently of each other and then analyzed the concept of investment in international investment law based on it, with emphasis on intellectual properties. based on current research results, globally, as to the concept of investment and protection of intellectual property rights, a broad approach is governed in international investment agreements, which are based on the pervasive effect of agreements arising from their protective clauses, in particular, most favored nation clause, has gradually turned into a universal rule and even promote reasonable protective standards in the field of the concept of investment and intellectual property rights. therefore reform of developing countries’s adopted procedures, specifically wto members is necessary. iran’s adopted procedure in bilateral investment agreements is the adoption of a broad approach to the concept of investment and protection of intellectual property. do not overdo it and status, manner, and scope of protection of investment and intellectual property rights can’t be the same for all countries and all the investment fields; especially regarding countries like iran, which do not accept even international requirements of trips agreement.
