مطالعۀ تطبیقی اصول و بایسته‌ های مرتبط با نهاد ناظر بر انتخابات و فرایند حاکم بر اعلام نتایج انتخابات

امروزه در قانون اساسیِ بسیاری از نظامات سیاسی، حق تعیین سرنوشت و مشارکت سیاسی مردم از طریق انتخابات به‌عنوان یکی از حقوق بنیادین آنان پذیرفته ‌شده است و از ملزومات زندگی اجتماعی و سیاسی آن جوامع محسوب می‌شود. یکی از مفروضه‌های اساسی در هر نظام انتخاباتی در سراسر جهان، وجود نهاد ناظر به‌عنوان نهاد بالادستی و تعیین‌کننده است که پاسدار آرای عمومی است. همچنین در مرحلۀ پساانتخابات نیز مسئلۀ اعلام نتیجه به‌عنوان مُهر خاتم از اهمیت فراوانی برخوردار است. به همین منظور نگارندگان این مقاله با استفاده از روش توصیفی- تحلیلی و با تکیه ‌بر اسناد کتابخانه‌ای معتبر و با نگاهی تطبیقی در پی پاسخ به این پرسش هستند که در راستای استیفای حقوق رای‌دهندگان در خصوص نهاد ناظر بر انتخابات و اعلام نتایج، چه اصول و الزاماتی وجود داشته و نظام‌های حقوقی در دنیا چه تدابیری برای آن اندیشیده‌اند؟ یافته‌های پژوهش نشان می‌دهد که با مطالعۀ نظام انتخاباتی دولت‌ها، اصولی چون قانونی بودن، استقلال، بی‌طرفی و حاکمیتی بودن برای نهاد ناظر و مواردی چون پاسخگویی، مستدل بودن و حفظ محرمانگی از مهم‌ترین اصول حاکم بر مرحلۀ اعلام نتایج انتخابات است و همچنین این اصول قوام‌بخش و حافظ حقوق شهروندان برای «انتخاب شدن» و «انتخاب‌ کردن» است.

nowadays, in the constitutional law of many political systems, the right to determine one’s destiny and political participation of people through elections is recognized as one of their fundamental rights and is considered essential to the social and political life of those communities. an essential assumption in any electoral system worldwide is the existence of an electoral oversight body as a supreme and determining institution that safeguards the general will; furthermore, in the post-election phase, the issue of announcing the results as the seal of approval holds great importance. to this end, this article aims to address the principles and requirements surrounding the oversight body for elections and announcing results using a descriptive-analytical method and relying on reputable library documents with a comparative perspective. the research findings indicate that by studying the electoral system existing within the legal framework of governments, the principles and necessities of the electoral oversight body and the announcement of results can be examined and scrutinized.
