چالش‌های چارچوب حقوقی خسارت محیط زیستی در صنعت نفت و گاز فراساحل

فعالیت‌های نفت و گاز فراساحل به فعالیت‌هایی اطلاق می‌شود که از تاسیسات دریایی (برخلاف تاسیسات خشکی) به‌منظور اکتشاف، بهره‌برداری و تولید نفت یا گاز استفاده می‌کنند. فعالیت‌های یادشده گاه با خطرهایی برای محیط زیست دریایی همراه است و خساراتی را برای محیط زیست و کشورهای مجاور ایجاد می‌نماید. حدود مسئولیت و میزان خسارت این حوادث، از موضوعات مهم در زمینۀ فعالیت‌های فراساحل است. جستار حاضر با روش توصیفی- تحلیلی به بررسی چارچوب حقوقی مسئولیت یادشده و چالش‌ها و نواقص مقررات بین‌المللی و منطقه‌ای موجود در صنعت نفت و گاز فراساحل پرداخته است. با وجود کنوانسیون‌های متعدد بین‌المللی و منطقه‌ای، نظام حقوقی مسئولیت محیط زیست در این صنعت در مراحل آغازین است و هنوز به‌طور کامل شکل‌ نگرفته است. هرچند موافقت‌نامه‌های منطقه‌ای نسبت به کنوانسیون‌های بین‌المللی در این زمینه پیشروتر هستند، اما باید در زمینۀ مسئولیت و میزان خسارت زیست‌محیطی، کنوانسیونی تدوین شود و به تصویب اکثریت کشورها برسد.

offshore oil and gas activities refer to activities that use marine facilities (as opposed to land facilities) for the purpose of exploration, exploitation, and production of oil or gas. the mentioned activities are sometimes associated with risks to the marine environment and cause damage to the environment and neighboring countries. the present essay has analyzed the legal framework of the mentioned responsibility and the challenges and shortcomings of the existing international and regional regulations in the offshore oil and gas industry with a descriptive-analytical method. despite numerous international and regional conventions, the legal system of environmental responsibility in this industry is in the beginning stages and has not yet been fully formed. although regional agreements are more advanced than international conventions in this field, a convention should be drafted and approved by the majority of countries in the field of responsibility and the amount of environmental damage.
