چالش های پیش روی توسعه ی حقوق بشر در حقوق بین الملل سرمایه گذاری

معاهدات دوجانبه ی سرمایه‌گذاری و رویه ی دیوان‌های داوری سرمایه‌گذاری در راستای تقویت حقوق بشر در حقوق بین‌الملل سرمایه‌گذاری گام‌هایی برداشته‌اند؛ اگرچه تحقق این مسئله به صورت تدریجی بوده است و ضرورت همکاری طرفین متعاهد و تلاشی در سطح بین‌المللی را می‌طلبد. نگارندگان این مقاله با روش توصیفی- تحلیلی و هدف تبیین چالش‌ها و موانع موجود بر سر راه توسعه و ارتقای حقوق بشر در نظام حقوق بین‌الملل سرمایه‌گذاری، راهکار‌هایی برای رفع این موانع ارائه می‌دهند. یافته‌های مقاله نشان می‌دهد حقوق بین‌الملل سرمایه‌گذاری در پیشبرد جریان سرمایه‌گذاری بین‌المللی، به حقوق بشر امعان ‌نظر داشته است. با این حال، با وجود توسعه ی حقوق بشر و تعهدات حقوق بشری در حقوق بین‌الملل سرمایه‌گذاری در چند دهه ی اخیر، این مسئله همواره با چالش‌هایی مواجه بوده است که می‌توان به چالش‌های سیاسی، صلاحیتی و همچنین صدور آرای متفاوت در موارد مشابه اشاره کرد. در مقابل به‌نظر می‌رسد می‌توان از انعقاد یک معاهده ی چندجانبه ی جهانی در زمینه ی سرمایه‌گذاری خارجی، صدور آرا با ابتنا بر موازین حقوق بشر و ایجاد رویه‌ای متحد‌الشکل به‌عنوان راهکارهایی برای برطرف کردن چالش‌های یادشده نام برد.

challenges ahead of human rights development in international investment law

bits and practice of investment arbitration tribunals have taken steps to reinforce human rights in international investment law, although it will be gradual and requires cooperation with contracting parties and efforts at the international level. this paper adopts a descriptive- analytical method and tries to provide solutions to overcome the obstacles that hinder human rights development by pointing to these challenges in the international investment law system. research findings indicate that international investment law has paid attention to human rights in the way of promoting international investment flow. despite development and promotion of human rights and human rights obligations in the international investment law in the last few decades, this issue has always been facing challenges and obstacles. the challenges have political and jurisdiction nature, and require different decisions in the same cases. it seems that solutions such as the codification of a multilateral international treaty on foreign investment, and awards rendered in accordance with the human rights obligations and arbitral practice could address the mentioned challenges.
