کاوشی در سازگاری اعلامیۀ اسلامی با اعلامیۀ جهانی حقوق بشر بر پایۀ دکترین حاشیۀ تفسیر

حقوق بشر از زمان تصویب اعلامیۀ جهانی در سال 1948م، مسیر جهان‌شمولی را درپیش گرفت و در میان رویکردهای مبتنی بر تنوع فرهنگی، اعلامیۀ وین در سال 1993م به‌صراحت مهر تاییدی بر جهان‌شمول بودن آن زد. صدور اعلامیۀ حقوق بشر واکنش‌های متفاوتی را در میان متفکران اسلامی موجب شد. گروهی بر این باور بودند که مفاد این اعلامیه منطبق با متون و منابع اسلامی است، دسته‌ای دیگر در طیف مقابل از نگاه شریعت اسلامی در مقام انتقاد برآمدند، و گروهی در میانۀ این طیف، جمع بین آموزه‌های اسلامی و مفاد اعلامیه را تحت شرایطی امکان‌پذیر دانستند. در میان گروه سوم، عده‌ای بر آن‌اند که با بازخوانی متون دینی می‌توان به سازگاری میان اسلام و حقوق بشر دست یافت به‌گونه‌ای که قرائت اسلامی از حقوق بشر به‌عنوان حاشیۀ تفسیر قابل پذیرش باشد. در این نوشتار، پذیرش اعلامیۀ حقوق بشر در اسلام به‌عنوان حاشیۀ تفسیر اعلامیۀ جهانی حقوق بشر مورد بررسی قرار می‌گیرد. بررسی‌های به‌عمل آمده در این نوشتار حاکی از آن است که گزارۀ پیش‌گفته نمی‌تواند درست باشد؛ از یک سو به‌رغم اشتراکات فراوان از نگاه بنیادی تبایناتی وجود دارد و از سوی دیگر، میان اعلامیۀ اسلامی و اعلامیۀ جهانی هیچ سلسله‌مراتبی حاکم نیست.

An Investigation of Compatibility of the Islamic Declaration with the Universal Declaration of Human Rights Based on Margin of Interpretation Doctrine

Since its adoption in 1948, the Universal Declaration of Human Rights has moved along the path of universalism and, in the context of diversitybased approaches, the Vienna Declaration in 1993 clearly affirmed its universality. TheDeclaration of Human Rights has led to different reactions among Islamic thinkers. One group believed that the provisions of this Declaration were in accordance with Islamic texts and resources, while others were criticizing it from the Islamic Shari’a perspective; a group in the midst of this spectrum believed in the combination of Islamic doctrine and the provisions of the Declaration. Among the third group, there are some who believe that by revising religious texts one can reconcile Islam and human rights so that the Islamic readings of human rights can be accepted as a margin of interpretation. This article examines the Islamic Declaration of Human Rights (Cairo Declaration) as the margin of the interpretation of the Universal Declaration of Human Rights. This paper indicates that the above proposition cannot be right; on the one hand, in spite of a large number of commonalities, there is a fundamental distinction; on the other hand, it is not possible to think of a hierarchical relationship between the Islamic Declaration and the Universal Declaration.
