واکاوی تشکیلات قضایی حکومت قراختاییان کرمان

تشکیلات قضایی همواره یکی از وجوه مهم نظام اداری حکومت ها به شمارمی رود و تمامی حکام، به دیوان قضا و قضاتی نیازمندند که بتوانند در زدودن عوامل فساد به آنها یاری رسانده، عدل و داد را اقامه کنند. حکومت قراختاییان کرمان نیز از این مهمّ مستثنی نبوده و ازهمین رو، هدف پژوهش حاضر آن است تا ضمن بررسی اهمیّت و جایگاه منصب قضاوت و کارکردهای قضات نزد قراختاییان کرمان، نحوۀ کار دیوان قضا در دوران حکومت مذکور را واکاوی کند و در پایان نیز مشهورترین قضات کرمان را که هم زمان با حکومت قراختاییان به قضاوت مشغول بوده اند، معرفی کند. در همین راستا پرسش اصلی نوشتار حاضر عبارت است از اینکه تشکیلات قضایی کرمانِ عصرِ قراختاییان چگونه بوده و مهمترین قضات عصر قراختایی چه کسانی بوده اند؟ نوشتار حاضر براساس ماهیت، از نوع تحقیقات توصیفی تحلیلی و تکنیک گردآوری اطلاعات آن نیز کتابخانه ای است. یافته های پژوهش دلالت بر آن دارد که قضات عهد قراختاییِ کرمان علاوه بر وظیفۀ دادرسی، فعالیت های مهمّ و متفاوت دیگری نیز داشته اند. دیگر آنکه هم زمان با عهد قراختایی در کرمان، دیوان یارغو و دیوان مظالم وجود داشته و در حکم نهایی علاوه بر نظر قضات، رای حاکم قراختایی و حتی در مواردی دستور ایلخانان مغولِ هم زمان با قراختاییان، اثرگذار بوده است.

Analysis of the Judiciary Organization of the QaraKhitai Government of Kerman

The judiciary has been always considered as one of the important aspects of the administrative systems of the governments, and all rulers need the Court of Justice and judges who can help them to eliminate the causes of corruption and to establish justice. The QaraKhitai government of Kerman province cannot be considered as an exception. So, it has been tried, in present paper, to study the importance and the position of their judiciary system and the function of judges for QaraKhitai government in Kerman to show how the Supreme Court worked during their period, and finally to introduce the most famous judges who interpreted and applied laws  when QaraKhitais were ruling in Kerman. In this regard, the main questions are: "How was judiciary organization of Kerman in the era of QaraKhitai government?", and "Who were the most important judges of this period?" The present study has been conducted through a descriptiveanalytic method on the basis of library documents. The results show that the judges held some other different and important responsibilities in addition to the task of judgment during the reign of QaraKhitai dynasty. The other issue was that along with the QaraKhitai’s judiciary system, there were other judicial systems in Kerman such as Yarghu Court (Divane Yarghu) and  public prosecutor’s office (Divane Mazalem), and  also, the QaraKhitai rulers’ opinion and, even in some cases, the orders of ruling Mongol Ilkhan could be effective on  the final judgments.
