بررسی تطبیقی حقوق و تعهدات طرفین پروانه بهره‌برداری از میدان‌های نفتی در ایران، نروژ و انگلستان

ذکر عنوان پروانه بهره برداری در قانون وظایف و اختیارات وزارت نفت می تواند ساختار جدیدی را برای واگذاری میدان‌های نفت و گاز کشور ایجاد نماید اما از آنجایی که در قانون به تعریف و چگونگی اعطای پروانه، مابه‌ازای آن و تعهدات دارنده اشاره ای نشده است، در این تحقیق برای جبران این خلا، عنوان پروانه آن‌طور که در نظام حقوقی معادن ایران و حقوق نفت و گاز کشورهایی چون نروژ و انگلستان آمده است، بررسی شده و بنا بر ضرورت ایجاد تنوع و انعطاف در مدل واگذاری و بهره برداری سریع تر از منابع نفتی با توجه به شرایط میدان‌های کشور و پیش بینی در مورد افزایش اقبال به انرژی های پاک، نتیجه حاصله نمایانگر تاثیر مثبت استفاده از پروانه مشروط به ایجاد تغییراتی در قوانین و تهیه آیین نامه خاص با ذکر دقیق تعهدات دارنده و ضمانت اجرای هر یک و تامین زیرساخت های لازم جهت نظارت و اعمال آن‌ها است.

mentioning the title of exploitation license in the law on duties and powers of the ministry of petroleum can create a new structure for handing over the country’s oil and gas fields, but since there is no definition of the license, how it is granted, compensation and obligations of the holder, to compensate for this gap, in this study the title of the license as stated in the legal system of iranian mines and oil and gas laws of countries such as norway and england was examined and according to the necessity of creating diversity and flexibility in the model of exploitation of oil resources according to the conditions of the country’s fields and the predictions regarding the increase in favor of clean energy, the result shows the necessity and positive effect of using the license subject to making changes in the laws and preparing specific regulations related to it and providing the necessary infrastructure to monitor it.
