حمایت از صنایع دستی در نظام حقوق مالکیت فکری ایران؛ با لحاظ مقررات موافقتنامه جنبه‌های تجاری حقوق مالکیت فکری سازمان تجارت جهانی‌ (تریپس)

مقاله حاضر به بررسی نظام حقوق مالکیت فکری ایران درخصوص صنایع دستی، با تاکید بر مقررات موافقت‌نامه جنبه‌های تجاری حقوق مالکیت فکری سازمان تجارت جهانی (تریپس) پرداخته است. صنایع دستی به عنوان موضوعی که می تواند مشمول حمایت نظام حقوق مالکیت فکری باشد تاکنون چندان مورد توجه قرار نگرفته است. از طرفی این نوع آثار هنری درسطح جهانی هم ازلحاظ مالکیت فکری و هم ازنظر تجاری اهمیت فزاینده‌ای پیدا کرده است. سوال اساسی که دراین مقاله مطرح و مورد بررسی قرار گرفته این است که رویکرد نظام حقوق مالکیت فکری ایران و توافقنامه تریپس نسبت به صنایع دستی چیست و چگونه می‌تواند به حمایت موثر از این آثار بپردازد؟ یافته‌های مقاله حاکی از آن است که صنایع دستی از مصادیق هنرهای تجسمی بوده و در نظام حقوقی ایران و توافق‌نامه تریپس و سایر اسناد بین‌المللی رویکرد یکسانی در خصوص آنها وجود ندارد. حقوق ایران می تواند در نظام های حق مولف (کپی رایت) و یا طرح‌ صنعتی، نشانه جغرافیایی و علامت تجاری مورد حمایت قرار گیرد. در توافقنامه تریپس نحوه حمایت به صورت کلی و بیشتر به جنبه های تجاری حقوق مالکیت فکری پرداخته شده و درخصوص حقوق ادبی هنری به کنوانسیون برن ارجاع داده است.

Protecting Handicrafts in Iran's Intellectual Property Rights System; Subject To the Agreement on Trade-Related Aspects of Intellectual Property Rights of the World Trade Organization, TRIPS

The present article examines the Iranian intellectual property rights system regarding handicrafts; emphasizes the provisions of the Agreement on TradeRelated Aspects of Intellectual Property Rights (WTO). Handicrafts as a subject that can be supported by the intellectual property rights system has not received much attention so far. On the other hand, this type of artwork has become increasingly important both globally and commercially. The main question raised in this study is what is the approach of the Iranian intellectual property rights system and the TRIPS agreement to handicrafts? And how can it effectively support these works?The findings of the article indicate that handicrafts are examples of visual arts and there is no uniform approach to them in the Iranian legal system and the TRIPS Agreement and other international documents. In Iranian law, it can be protected in copyright or industrial design systems, geographical indications and trademarks. The TRIPS Agreement addresses the commercial aspects of intellectual property rights in general and in particular, and refers to the Berne Convention on literary and artistic rights.
