کودکان در محاصره اسباب بازی های هوشمند:حمایت از حریم خصوصی کودکان در اینترنت اسباب بازی ها

اسباب بازی های هوشمند متصل به اینترنت، که قادرند با کودک ارتباط برقرار و اطلاعاتی را از او دریافت و برای یک رایانه مستقر در مکان دیگر ارسال کنند، در کنار مزایایی چون سرگرمی و آموزش، حریم خصوصی کودکان را با احتمال جدی نقض مواجه کرده اند. اطلاعات جمع آوری شده از کودک، ممکن است توسط سازنده اسباب بازی مورد سو ء استفاده قرار گیرد یا اشخاص ثالث به طور غیرمجاز به آنها دست یابند. در جستار حاضر، به روش توصیفی تحلیلی، چالش های اسباب بازی های هوشمند برای حریم خصوصی کودکان و راهکارهای حقوقی رفع آنها بررسی شده است. حقوق آمریکا با قوانین و مقرراتی که سابقا راجع به حریم خصوصی کودکان در فضای مجازی تصویب کرده، سطح حمایتی نسبتا مطلوبی را برای کودکان تامین کرده است. اما حقوق ایران در این زمینه با نقص جدی مواجه است؛ لذا، نویسندگان با استفاده از راهکارهای حقوق آمریکا، پیشنهاد داده اند در نظام حقوقی ایران نیز قانون خاصی در این راستا تصویب یا قوانین موجود اصلاح شود. برخی قواعد و احکام عام فقه امامیه موید ضرورت حمایت از حریم خصوصی کودکان در اینترنت اسباب بازی ها است.

Children surrounded by smart toys: Protection of children’s privacy in the internet of things

Smart toys connected to internet, which are able to communicate with the child and obtain some information from him/her and send it to a computer located elsewhere, in addition to benefits such as entertainment and education has faced the children rsquo;s privacy with serious probability of violation. The personal information collected from the child, may be misused by the manufacturing company or a third party may have illegal access it illegally. The challenges of smart toys for children rsquo;s privacy and their legal solutions have been studied. The U.S law, with laws and regulations concerning children rsquo;s privacy passed previously has provided a relatively desirable level for children. However, the Iranian law is faced with serious deficiency in this regard. Therefore, the authors have, using the American law solutions, recommended that a new law is should be passed or current laws could be modified. Some general rules and verdicts of the Imami jurisprudence confirm the necessity of protecting the children rsquo;s privacy in the internet of toys.
