مطالعه تطبیقی انسان‌گرایی در حقوق بین الملل سنتی و معاصر

حقوق بین الملل مجموعه اصول و مقرراتی است که برای تنظیم روابط تابعان فعال حقوق بین الملل یعنی دولت ها و سازمان های بین المللی با یکدیگر در جامعه بین المللی به کار می رود. حاکمیت دولتها در شکل گیری چنین مقرراتی نقش محوری داشته است. با این حال در چند دهه اخیر شاهد تضعیف این حاکمیت دولتها به نفع بشر و بشریت بوده ایم. توجه به حقوق بشر و ایجاد گفتمانی غالب در مناسبات بین المللی در خصوص بشر و منافع بشریت باعث گردیده حاکمیت مطلق و وستفالیایی دولتها رنگ باخته و با مسئولیت دولتها در حفظ حقوق بشر گره خورد. بی شک اندیشه های انسان گرایی در شکل گیری چنین فرآیندی بی تاثیری نبوده است.این تحقیق سعی دارد با روشی توصیفی تحلیلی، به بررسی این فرآیند بپردازد.

The Comparative study of Humanism in Traditional and Contemporary International Law

International law consist of the set of Principles, Rules and Regulations that accepted for Relations between States and International Organizations in International Community. Sovereignty of State would have a central role in creation of these Regulations. However, Sovereignty of State has been weakened in favor of Human and Humanity duration last few Decades. Focus on Human Right and its benefit and discourse making for that on International Relation cause to Fading out Westphalian Sovereignty while Responsibility of State for Protection of Human Right has been Highlighted. No doubt Humanist Thoughts has important effects on this process. This article tries study that process by using Descriptive - Analytical Research Method.
