مسوولیت بین المللی دولت‌ها ناشی از تخریب محیط زیست در مخاصمات مسلحانه بین‌المللی (مطالعه تطبیقی حقوق بین الملل محیط زیست و حقوق بین الملل کیفری)

مخاصمات مسلحانه به هر عنوان و در هر کجای این کره خاکی که روی دهد، پیامدهای گونا‌گونی درپی دارد که یکی از عمده‌ترین آن‌ها، تخریب و ایراد صدمه به محیط زیست است که در راستای صیانت از محیط زیست در مخاصمات مسلحانه بین المللی، قواعدی برای حمایت از محیط زیست در حوزه های مختلف حقوق بین الملل تدوین شده و اصول و قواعد مسوولیت بین المللی دولتها ناشی از تخریب محیط زیست در مخاصمات و الزام آنها به جبران خسارات وارده تبیین شده است. این حوزه ها در حال حاضر به طور کلی تابع قواعد کلی مسوولیت بین المللی در حقوق بین الملل عمومی هستند که با توجه به پیشرفت چشمگیر حقوق بین الملل محیط زیست و حقوق بین الملل کیفری در دهه های اخیر تدوین قواعد مسوولیت بین المللی خاص در جهت حفاظت از محیط زیست در مخاصمات مسلحانه بین المللی لازم و ضروری است. در این مقاله تلاش شده با تحلیل قواعد حاکم بر حقوق بین الملل محیط زیست و حقوق بین الملل کیفری، حدود و آثار مسوولیت دولتها ناشی از نقض مذکور بررسی شود. شناسایی چالش‌ها و پیچیدگی های مرتبط با تعیین مسوولیت بین المللی دولتها در این رابطه از دیگر دستاوردهای این پژوهش است.

International responsibility of governments caused by environmental degradation in international armed conflicts (comparative study of international environmental law and international criminal law

Armed conflicts in each and every place of this planet have different consequences, one of the most important of which is the destruction and damage to the environment. In order to protect the environment in international armed conflicts, the rules for environmental protection in the areas of international law has been conducted and the principles and rules of international responsibility of governments have been explained the destruction of the environment in the conflict and their obligation to compensate for the damage. These areas are currently subject to the general rules of international responsibility in international public law, due to the significant progress made by international environmental law and international criminal law, in recent decades, the elaboration of specific international rules for protecting the environment in international armed conflicts is necessary.This article attempts to examine the limits and effects of the responsibility of States resulting from these violations by analyzing the rules governing international environmental law and international criminal law. Identifying the challenges and complexities associated with determining the international responsibility of governments in this regard is another achievement of this study.
