معیار شهرت عمومی در دعاوی مسوولیت مدنی ناشی از بدگویی و نقض حریم خصوصی (مطالعه تطبیقی در حقوق ایران و آمریکا)

یکی از اهداف نظام های حقوقی پاسداری از حیثیت، اعتبار و حریم خصوصی افراد جامعه است. از دیگر سو، ‌لزوم در نظر گرفتن نفع جامعه در کسب اطلاعات و آزادی بیان انکارناپذیر است. تقابل این دو آرمان می تواند موجب طرح دعاوی جبران خسارت مدنی شود. در حقوق مسوولیت مدنی آمریکا، با تفکیک شخصیت های مشهور از سایر افراد، کوشش شده است تا تعادلی نسبی میان حق بر آزادی بیان و اطلاع رسانی، از یک سو و حق بر جبران خسارت به دلیل لطمه به حیثیت، از دیگر سو برقرار شود. این مقاله بر آن باور است که دادگاههای مدنی ایران می توانند در دعاوی جبران خسارت از سوی اشخاص مشهور، برای صدور رای به جبران خسارت به دلیل ورود ضرر معنوی و آسیب به حیثیت این دسته از اشخاص، معیار سرسختانه تری را اعمال کنند. اعمال معیار شهرت عمومی در عرصه مسوولیت مدنی بستر تبادل آسان تر اطلاعات را راهم و از طرح پاره ای دعاوی در نظام قضایی پیشگیری خواهد کرد. این رویکرد البته لطمه ای به امکان جبران خسارت افراد، که نیاز بیشتری به حمایت قانونی دارند، وارد نمی کند.

Defemation, Privacy, and the Role of Public Figures: A Comparative Study of Iran and the U.S. Legal Systems

Legal systems around the world have adopted different approaches to protecting the privacy and integrity of citizens. However, protecting these values at times runs into conflict with principles such as freedom of speech and access to information. Moreover, the rise of social media platforms has intensified this conflict. In the U.S., the recognition of public figure and ldquo;actual malice rdquo; standard in defamation and privacy lawsuits has been a critical move in balancing the different values at stake. This Article studies the role of public figure standard in the U.S. defamation and privacy laws. It proposes that recognizing the differences between public figures and private persons in Iran rsquo;s tort law system can also help balance the various interests of the Iranian society and reduce the floodgate of defamation lawsuits. This approach will not undermine the right of private individuals who need the legal system rsquo;s guaranteed protection of their reputation and privacy.
