تکوین قواعد علم حقوق بر اساس نظام مسئله-حکم

در رهگذر تکوین قواعد علم حقوق در دو مکتب بزرگ و پر شاخ برگ حقوق طبیعی و حقوق موضوعه، راه رسیدن به قواعد از یک فرمول مشخص و سازمان یافته تبعیت نمی کند. به گونه ای که اقناع طرفدارن هر یک از این مکاتب در جهت معقولانه بودن قواعد وضع‌شده توسط آن‌ها کار سختیست چه رسد به آنکه بخواهند پیروان آن مکتب رقیب را قانع نمایند. در سیر تکوین قواعد علم حقوق روش های گوناگونی توسط ملل مختلف تجربه گردیده است و در این مقاله ضمن مرور آن‌ها، سعی در معرفی روشی نمودیم که تا حدودی برگرفته از نظام حقوقی اسلام است. در این روش که آن را نظام مسئلهحکم می خوانیم، هر نابهنجاری انسانی و اجتماعی را یک مسئله در نظر می‌آوریم که با پدیداری به نام حکم در صدد پاسخ دادن به آن می باشیم. اما باید بدانیم که در نظام مسئله حکم، حکم به‌عنوان پاسخ یک مسئله، نمی‌تواند صرفاً یک اراده انتزاعی و محض باشد. حکم باید واجد خصوصیاتی اجباری باشد تا بتواند یک پاسخ کافی برای مسئله خود به حساب آید.

Rules of law Genesis on the basis of problem-judgment (problem solving) system

Through the development of rules in natural law and positive law we cannot see an organized way or specific formula for making rules. So that it’s difficult to each of theme for satisfy their fans that their rules is reasonable. And of course both of theme fails in satisfy other school’s fans. We know that the evolution of rules of law follow up by any nations in different way and we review their experience in this article. After this، we try to introduce a new approach that is partially derived from the Islamic legal system. In new approach that we named it as ProblemJudgment system، every anomaly or abnormal phenomena in the society considered as a problem that we must response it by judgment. This method is very similar to problem solving system in the science. In problemjudgment system، judgment is not merely an abstract or pure will. Judgment is eligible for solving the problem, when has certain mandatory specifics to be considered a sufficient answer to their problem.
