تبیین تاثیر بعد اعتقادی و اندیشه ای در مساله ازدواج مسلمان با غیر مسلمان

نکاح مسلمان با غیرمسلمان از مباحثی است که از ابتدای شکل‌گیری جامعه اسلامی مطرح است؛ و با رشد ارتباطات بین جوامع و سکونت افراد باعقاید و گرایش‌های مختلف در همه جهان، نیاز به پاسخ این مسئله را می طلبد. در این نوشته نویسنده در صدد بازنگری ادله ازدواج هر مسلمانی چه زن و چه مرد با هر غیر مسلمانی چه کتابی و چه کافر و با هر عقیده و مذهب مخالف اسلام است. حاصل این پژوهش که به شیوه تحلیلی و توصیفی و با روش کتابخانه‌ای است بیانگر آن است که آیات و روایات ارائه‌شده برای استناد حرمت به دلیل احتمال انصراف به کفارِ معاند اسلام، فاقد اطلاق می‎باشند و با لحاظ اصل اولی جواز نکاح انسان با هر جنس مخالفی که فطرت آدمی هم آن را مجاز می‎شمارد و دلیل قطعی بر رد آن وجود ندارد، می‌توان نتیجه گرفت: نکاح مسلمان با شخص غیرمسلمانی که ضدیتی با اسلام نداشته و اختلاف عقاید را محترم می‎شمارد بلامانع باشد.
