شروط اخلاقی و الزامات حقوقی بازتوزیع ‌ثروت در جامعه ازدیدگاه قرآن

باز توزیع ثروت از مهمترین بحث‌های نظام اقتصادی اسلام است که در بسیاری از آیات مکی و مدنی بر آن تاکید شده است. هدف از انجام این تحقیق، دست‌یابی به نظر قرآن در این موضوع با توجه به جنبه‌های اخلاقی و حقوقی مرتبط با آن است. رهنمودهای‌های اخلاقی و حقوقی قرآن در بازتوزیع ثروت ناظر به حفظ آبروی نیازمندان و کاهش عملی و موثر فقر در جامعه است و مقایسه دیدگاه قرآن با دیگر مکاتب اقتصادی در حوزه بازتوزیع ثروت، ضعف آنها را آشکار می‌کند. این پژوهش با روش توصیفی تحلیلی انجام شده و برای استخراج نظر قرآن از روش تفسیر موضوعی بهره‌برده است. یافته‌های تحقیق نشان می‌دهد که از نظر قرآن، بازتوزیع ثروت امری مطلوب و ارزشمند است که با هدف تامین نیاز نیازمندان با حفظ کرامت آنان در بالاترین سطح و برحسب اولویت‌بندی آنان انجام می‌گیرد و دو شرط اخلاقی دارد؛ پرهیز از منت‌گذاری و استفاده از ساز و کار کمک پنهانی. همچنین، مطابق آموزه‌های قرآن، این کار با الزامات حقوقی ذیل پشتیبانی شده است: منتفع کردن نیازمندان از اموال ثروتمندان، حق دسترسی نیازمندان به ثروت‌های عمومی و وضع قوانین مالی مرتبط با رفع مشکل نیازمندان توسط مردم و دولت.

ethical conditions and legal requirements of redistribution of wealth in society from the perspective of the qur’an

this article examines the ethical and legal conditions and requirements related to the redistribution of wealth in the economic system of islam based on the teachings of the quran. the purpose of the research is to explain the qur’an’s opinion about the importance of wealth redistribution in line with the need to meet the needs of the needy while maintaining their dignity. it indicates the effectiveness of the legal requirements established for the practical reduction of poverty in the society and points out the weakness of the views of the capitalist economic schools in this field. the research method in this article is descriptive-analytical and it uses the interpretation method to extract the opinion of the qur’an. the findings of this research indicate that according to the qur’an, redistribution of wealth is a valuable thing that is done with the aim of providing the dignity of the needy at the highest level and with regard to their prioritization and considering the two moral conditions of avoiding bequests and using the hidden aid mechanism. also, according to the teachings of the qur’an, this work is supported by the following legal requirements: benefiting the needy from the property of the rich, the right of the needy to access public wealth, and establishing financial laws related to solving the problem of the needy by the people and the government
