حبط قرآنی و بطلان فقهی؛ از همانندی تا هم‌پوشانی

مفسران در تبیین معنای مفردات قرآنی، دیدگاه یکسانی ندارند. از سوی دیگر، فقیهان در بیان کیفیت مفاهیم گاه یکدست عمل نمی کنند. در هر کدام از دو گروه، نظر مشهوری وجود دارد که سایر تلقی ها در مقابل آن، در کسوت دیدگاه شاذ و نادر، خودنمایی می کند. در قرآن کریم، واژه «حبط» بیشتر با تعبیر مرکب «حبط اعمال» به کار رفته است که نشان از نابودی اعمال دارد. از سوی دیگر، در فقه نیز تعبیر بطلان به اعمال نسبت داده می شود که این هم حاکی از نابودی آن اعمال (عبادات یا معاملات) است. آیا بطلان فقهی، همان حبط قرآنی است؟ باور به نسبت و رابطه «عموم خصوص من وجه» این دو مفهوم، دارای ادله متعدد و قوی است. اسباب حبط و عوامل بطلان نیز در برخی موارد، همپوشانی دارد.

Quranic Revocation (Habt) and Invalidity in Jurisprudence; from similarity to Overlap

Commentators do not share the same viewpoints in explaining the meaning of Qur’anic words. On the other hand, jurisprudents do not act uniformly in the meaning of the concepts. In each of the two groups, there is a popular view that the other views against it seems as a rare view. In the Holy Qur’an, the word abolish(Habt) is more commonly used in the compound sense of abolish deeds which means the destruction of deeds. In jurisprudence, on the other hand, the interpretation of falsehood is attributed to actions, which implies the destruction of those practices (worship or transactions). Is invalid jurisprudence the same as revocation (Habt) in Qur’an? The conviction that the examples of these two concepts cover and coincide each other has many strong arguments. The causes of revocation (Habt) in Qur’an and the causes of inoperative in jurisprudence also overlap in some cases.
