تبیین فقهی زایمان انتخابی و مخاطرات جسمی مادر و جنین

زمینه و هدف: گاه والدین تمایل دارند که تولد فرزندشان در تاریخ خاصی ثبت شود که در این راستا بدون وجود دلیلِ پزشکی موجه، تقاضای زایمان زودهنگام را دارند که از نظر علم پزشکی دخالت در تاریخ زایمان، عوارض و مخاطراتی را برای مادر به‌ همراه دارد. حال این پرسش به ذهن خطور می‌کند که، آیا می‌توان جهت زایمان انتخابی با دخالت در زمان وقوع زایمان، حیات و سلامتی مادر را به مخاطره انداخت؟مواد و روش‌ها: در تدوین مقاله حاضر از روش کتابخانه‌ای و اسنادی و روش توصیفی تحلیلی استفاده شده است. در راستای به دست آوردن حکم زایمان انتخابی با در نظر گرفتن شخصیت جسمی مادر، ادله دو احتمال «جواز» و «عدم جواز» مطرح شد و با بیان «جواب نقضی»، ادله حکم به جواز منتفی شدند و در ادامه، با بیان اهمیت حفظ حیات و سلامتی بدن در آیات و روایات حکم «عدم جواز» اقدام به زایمان انتخابی اثبات شد.نتیجه‌گیری: یافته‌ها حاکی از آن است که، از منظر پزشکی، تغییر در تاریخ زایمان، عوارضی را برای مادر به همراه دارد ازجمله، عفونت، خونریزی، آسیب به اندام‌های داخلی و ... که از دیدگاه فقها، والدین نمی‌توانند با انتخاب تاریخ تولد دلخواه خود و همچنین به خطر انداختن سلامتی و حیات مادر، به شخصیت جسمی وی لطمه وارد نمایند.

jurisprudential explanation of elective cesarean section and mother’s and fetus’ physical risks

background and aim: sometimes parents want their child's birth to be registered on a certain date and they request early delivery without valid medical reason. from the point of view of medical science, changing the birth date brings complications and risks for the mother. now this question is raised: is it possible to endanger the mother’s life and health by interfering with the delivery time?materials and methods: this descriptive-analytical article was conducted with a library and documentary method. in order to obtain a decree of elective cesarean section, taking into account the physical personality of the mother, the evidences of two possibilities permissibility and non-permissibility were presented. the evidence of the verdict in favor of permission was rejected with the expression contradictory answer. then, according to the importance of preserving the life and health of the body in the verses and traditions, the ruling of non-permissibility of elective cesarean section was proved.conclusion: the results indicate that from a medical point of view, changing the date of birth brings complications for the mother; including infection, bleeding, damage to internal organs, etc. from the point of view of jurists, parents cannot endanger mother’s health and life and harm her physical personality by choosing the desired date of birth of their child.
