بررسی حکم فقهی ویرایش ژنوم با مقاصد درمانی

زمینه و هدف: یکی از اقسام پژوهش‌ها و اقدامات در زمینه ژن انسانی، ویرایش ژن به قصد درمان بیماری است. متخصصان با کشف فناوری نوین تحت عنوان «کریسپرکس 9» یا ویرایشگر ژن، این توانایی را ایجاد نمودند که با حذف یا ویرایش ژن‌های نامطلوب و بیماری‌زا در بدن، مبادرت به درمان ورزند و زندگی بیمار را احیا نمایند. از آنجا که منشا بسیاری از بیماری‌های انسان ژنتیک است؛ لذا پژوهش پیرامون حکم فقهی ابزاری که توانایی اصلاح ژن را به عهده دارد ضرورتی اجتناب‌ناپذیر است. این نوشتار با هدف بررسی حکم فقهی ویرایش ژنوم با مقاصد درمانی، اقوال فقیهان موافق و مخالف را مورد واکاوی قرار داده و دیدگاه معتدلی ارائه می‌دهد.مواد و روش‌ها: مطالب پژوهش حاضر با روش توصیفی تحلیلی و مراجعه به منابع کتابخانه‌‌ای از طریق فیش‌برداری سامان یافته است.نتیجه‌گیری: حکم فقهی استفاده از فناوری ویرایشگر ژنوم مورد اختلاف فقیهان است. نگارندگان با امعان نظر در ادله به این نتیجه دست یافته‌اندکه تغییرات لازم در ژنوم انسان با انگیزه درمان تا جایی که موجبات ارتقای جسمی و روحی او را فراهم کند و ضرر و نقصان قابل توجهی نداشته باشد هیچ مغایرتی با خلقت الهی ندارد و حکم جواز آن با استناد به ادله‌ای چون اصل اباحه، وجوب تداوی و حفظ نفس، قاعده تسلیط، عروض عناوین ثانوی و ترغیب دین به تسخیر و کشف سنن الهی توجیه‌پذیر است.

studying the jurisprudential decree of genome editing for therapeutic purposes

background and aim: one of the types of research and actions in the field of human genes is gene editing for the purpose of treating diseases. by discovering a new technology called crisperx 9 or gene editor, specialists could treat and save the patient's life by removing or editing undesirable and pathogenic genes in the body. because genetic is the origin of many human diseases; the research on the jurisprudential decree of a tool that is able to modify genes is an inevitable necessity. this article analyzes the statements of agree and disagree jurists and presents a moderate point of view with the aim of studying the jurisprudential decree of genome editing for therapeutic purposes. materials and methods: the present research has organized by descriptive-analytical method and reference to library sources through file collection. conclusion: the jurists have different opinions on jurisprudential decree of using genome editing technology. the authors concluded, by considering the evidence, that the necessary changes in the human genome with the motive of treatment to the extent that it provides the means for his physical and mental improvement and does not cause any significant damage, has no contradiction with the divine creation and its permissibility can be justified by citing arguments such as the principle of obscenity, the necessity of self-treatment and self-preservation, the rule of consolation, the presentation of secondary titles, and the encouragement of religion to conquer and discover divine traditions.
