تاملی بر رویکرد عقل گرایانه و شریعت مدارانه، در متون شاخص دورۀ تمدن اسلامی در زمینه مبانی اخلاق و حقوق پزشکی

زمینه و هدف: مبانی اخلاق و حقوق پزشکی ، همواره در کتب اخلاق پزشکی و یا آثار متضمن آن، در تمدن اسلامی با رویکردهای مختلف محل توجه و بحث بوده است. تبیین داده های این آثار و رویکرد پزشکان و باید و نبایدهای اخلاق و حقوق پزشکی، برای ایجاد تمدن نوین اسلامی اهمیت دارد. هدف از این مقاله بررسی رویکرد عقل گرایانه و شریعت مدارانه در آثار برخی از پزشکان در زمینه مبانی اخلاق و حقوق پزشکی است.مواد و روش‌ها: این یک پژوهش اصیل بنیادی، با روش توصیفی- تحلیلی،  متمرکز بر متون شاخص اخلاق و حقوق پزشکی در دورۀ تمدن اسلامی، بویژه کتاب الماء نوشته ابومحمد ازدی، است.  با جستجوی مستقیم کلیدواژه های ادب الطبیب، آداب الاطباء، حقوق بیمار، ابومحمد ازدی  و مطالعه مکرر کتاب الماء، مفاهیم مرتبط با هدف پژوهش استخراج، دسته بندی، تحلیل و سپس مکتوب گردید. برای ارایه پیشینه پژوهش نیز کلیدواژه ها در پایگاه‌های اطلاعاتی magiran ، noormags ، sid ، scopus ، pubmed جستجو شدند.ملاحظات اخلاقی: در این پژوهش تمامی اصول اخلاقی و امانتداری در ارجاع دهی به مستندات بطور کامل رعایت شده است.یافته‌ها:  دو رویکرد عقل گرایانه و شریعتمدارانه، ناظر به اخلاق و حقوق و آداب پزشکی در بین پزشکان ادوار تمدن اسلامی که از شهرت فوق العاده ای در تاریخ و اخلاق پزشکی نیز برخوردارند، قابل مشاهده است. هریک از این دو رویکرد نمایندگانی دارد. رازی  با تکیه بر عقل و محمد ازدی و قطب الدین شیرازی با توجه­ای ویژه به شریعت، نمایندگان دو رویکرد عقل گرایانه و شریعتمدارانه هستند.  نتیجه گیری: این دو رویکرد از دید پژوهشگران معاصر یا مغفول مانده و یا با یکسان انگاری، از آن عبور کرده اند. اندیشه ایجاد تمدن نوین اسلامی توجه به دو رویکرد یادشده را اجتناب‌ناپذیر می سازد.

a reflection on two rationalist and shariat-based approaches, in theindex texts of the period of islamic civilization in thebasics of ethics and medical law

background and aim: the basics of ethics and medical law, always in medical ethics books or its implied worksin islamic civilization. it has been the focus of attention and discussion with different approaches. explaining thedata of these works and the approach of doctors and the dos and don'ts of medical ethics and law, it is importantfor the creation of a new islamic civilization. the purpose of this article is to investigate two rationalistic andsharia-based approaches in the implied works of some doctors in the basics of ethics and medical law.methods: this is an original fundamental research, with a descriptive-analytical method, focused on the textsof ethics and medical law in the period of islamic civilization, especially the kitāb ul mā written by abumuhammad azdī. by directly searching the keywords of adab al-tabib, medical ethics, patient rights, abumuhammad azdī and repeated reading of kitab al-ma'a, concepts related to the purpose of researchextraction, classification, analysis and then it was written. to present the background of the research, keywordsin the databases magiran, noormags, sid, scopus, pubmed were searched.ethical considerations: in this research, all ethical and trustworthiness principles have been fully observed inreferring to documents.results: two rationalistic and shariat-based approaches, looking at ethics, law and medical ethics tworationalistic and shariat-based approaches, looking at ethics, rights and medical etiquette among doctors in theperiods of islamic civilization who also have a great reputation in the history and ethics of medicine, is visible.each of these two approaches has representatives. razi, relying on reason and muhammad azdī and quṭb ad-dīn ash-shīrāzī, with special attention to sharia, are the representatives of two rationalist and sharia-basedapproaches.conclusion: these two approaches from the perspective of contemporary researchers or they have beenneglected or they have passed through it with a homogenization. the idea of creating a new islamic civilizationmakes it inevitable to pay attention to the two mentioned approaches.
