تحولات تاریخی حفاظت از دارو از عهد پیشامدرن تا عصر پسامدرن: رویکردی حقوقی در جعل دارو

زمینه و هدف: بررسی سیر تحولات روش‌های حفاظت از دارو از دوره پیشامدرن تا پسامدرن در 3000 سال قبل از میلاد تاکنون برای دستیابی به درک جامعی از شناسایی روندها، الگوهای تاریخی و راهبردهای مبتنی بر شواهد در راستای پرداختن به معضل داروهای تقلبی در عصر حاضر، حیاتی است. ردیابی این مسیر تکاملی، بینش‌های ارزشمندی را در زمینه بافت تاریخی، چالش‌ها و پیشرفت‌های حاصل‌شده در مقابله با عمل غیر قانونی تولید و توزیع داروهای تقلبی ارائه می‌کند. این نوشتار به مسیر تاریخی تلاش‌ها برای محافظت از محصولات دارویی با هدف منع جعل در طول زمان می‌پردازد و تحولات تاریخی کلیدی، نوآوری‌ها و چهارچوب‌های نظارتی را که چشم‌انداز ایمنی دارویی و اقدامات ضد جعل را شکل داده‌اند، به تصویر می‌کشد.روش: این تحقیق به شیوه تحلیلی توصیفی و به روش کمّی دوره‌پژوهی و بر پایه مستندات و منابع آرشیوی معتبر شامل کتب و مقالات داخلی و خارجی با جستجوی واژگان کلیدی قوانین، حفاظت از دارو، سلامت عمومی، جعل، دوران باستان، مدرن و پسامدرن در پایگاه علمی الکترونیکی گوگل اسکولار، به بررسی وضعیت حفاظت از محصولات دارویی و چگونگی تکامل قوانین و مقررات آن در بازه زمانی 3000 سال قبل از میلاد تا سال 2024 پرداخته است.ملاحظات اخلاقی: در این مطالعه ملاحظات اخلاقی، صداقت و امانتداری در ارجاع متون به منابع مورد استفاده، رعایت شده است.یافته‌ها: تکامل اقدامات قانونی برای حمایت از محصولات دارویی نشان‌دهنده گذار از قوانین عرفی بدوی به چهارچوب‌های رسمی در دوران مدرن است. معرفی دارونامه‌ها و قوانین حمایت از مصرف‌کننده، پیشرفت‌های قابل توجهی را در تنظیم کیفیت و اصالت دارو نشان داد. رویکردهای قانونی و اخلاقی برای حمایت از محصولات دارویی از دوران پیشامدرن تا پسامدرن تکامل چشم‌گیری یافته و با پیشرفت‌های تکنولوژیکی همراه شده است.نتیجه‌گیری: با الهام از تحولات تاریخی و انطباق با چالش‌های جدید، بر لزوم تداوم هوشیاری و توسعه نوآوری و فناوری‌های نوین در محافظت از سلامت عمومی و اطمینان از ایمنی و اثربخشی محصولات دارویی، تاکید می‌شود. تغییر راهبردهای قانونی مربوط به شیوه‌های نظارتی از رویکرد واکنشی، به موضع فعال و عملی متمرکز بر پیشگیری، ضروری است.

background and aim: examining the evolution of drug protection practices from the pre-modern to the postmodernera, dating back to 3000 bc, is essential to gain a comprehensive understanding of trends, historicalpatterns and evidence-based strategies for addressing the problem of counterfeit drugs in the modern era.tracing this evolutionary path provides valuable insights into the historical context, challenges and advancesmade in combating the illicit production and distribution of counterfeit drugs. this paper traces the historicaltrajectory of efforts to protect pharmaceutical products against counterfeiting over time and outlines keyhistorical developments, innovations and regulatory frameworks that have shaped the landscape of drug safetyand anti-counterfeiting efforts.methods: this research, using an analytical-descriptive and quantitative coursework method, based on reliabledocumentation and archival sources, including domestic and foreign books and articles, has examined the statusof the protection of pharmaceutical products and how its laws and regulations have evolved over the periodfrom 3000 bc to 2024 by searching for the keywords laws, drug protection, public health, counterfeiting,ancient, modern and postmodern in the electronic scientific database google scholar.ethical considerations: in this study, ethical considerations, honesty and trustworthiness have been observedin referencing texts to the sources.results: the evolution of legal measures to protect pharmaceutical products shows the transition fromprimitive customary laws to formal frameworks in the modern era. the introduction of pharmacopoeias andconsumer protection laws marked significant advances in regulating the drug quality and authenticity. legaland ethical approaches to protect pharmaceutical products have evolved significantly from the pre-modern tothe post-modern era, accompanied by technological advances.conclusion: inspired by historical developments and adapting to new challenges, it emphasizes the need forcontinued vigilance and the development of innovation and new technologies in protecting public health andensuring the safety and efficacy of pharmaceutical products. it is essential to shift regulatory strategies relatedto regulatory practices from a reactive approach to a proactive and practical stance focused on prevention.
