اخلاق جنگ از دیدگاه امام خمینی

چکیده
|
در میان سه سنّت عمدهی اخلاق جنگ، نظریهی جنگ عادلانه بیش از همه مورد توجه قرار گرفته و تحقیقات در حوزهها و مباحث آن، شتاب و وسعت قابل توجهی یافته است. در این مقاله، عرضهی سوالات بنیادین این حوزه بر اندیشهی امام خمینی(ره) و بازسازی آرای ایشان در این زمینه است. لذا پس از مرور سنتهای مزبور و با ارائهی قرائتی مبتنی بر روش درونفهمی از آثار و بیانات امام خمینی(ره)، استدلال خواهد شد که آراء ایشان در خصوص اخلاق جنگ با سنت جنگ عادلانه شباهت بیشتری دارد؛ این تشابه در مباحث مربوط به آغاز جنگ (دلایل عادلانه، نیّت صحیح، مراجع ذیصلاح تصمیمگیری، جنگ به عنوان آخرین حربه) و حین جنگ (تفکیک و تمییز افراد دخیل در جنگ و بیگناهان) و خاتمهی جنگ (رعایت حقوق مردم دولت شکست خورده، مجازات متجاوزین و خاطیان، تاسیس حکومت مردمی و پایان دادن به اشغالگری) مشاهده میشود. ولی رویکرد نیتمدار، فضیلتمحور و تکلیفمدارِ امام خمینی(ره) در حوزهی اخلاق باعث شده تا آرای ایشان با قواعد و اصول نتیجهمدارِ متفکران سنت جنگ عادلانه در حوزههایی نظیر تناسب (سنجش سود و زیان ورود به جنگ)، شرط احتمال موفقیت (در صورت مبادرت به جنگ) و تاثیر دوگانهی جنگ (سنجش میزان تلفات از میان افراد بیگناه نسبت به دستاوردهای حملات) مباینت داشته باشد. البته شباهتها و توازیهای آرای امام خمینی(ره) با سنت مزبور، لزوماً از شباهت محتوایی و مبنایی حکایت نمیکند و حداقل قسمتی از آن به منابع مشترک آرای امام و سنت مذکور برمیگردد.

Abstract
|
Among the three main traditions of ethics of war, just war theory is the most flourishing and developed one. The aim of this paper is reconstruction of ethics of war inherent in the works of Imam Khomeini. Then after reviewing the main traditions, and based on comprehensive reading of his work and speeches, it will be argued that the ethics of war implicated by or articulated in the writings and sayings of late Imam Khomeini is more compatible with the tradition of just war; especially in the fields of jus ad bellum (just cause, proper authority, right intention, last resort), jus in bello(discrimination between combatants and noncombatants) and jus post bellum(observing human rights, terminating occupation, establishing a popular government and prosecution of perpetrators of war crimes).But virtue intention and dutybased ethics of Imam Khomeini –against the consequentialist approach of thinkers of just war theorymakes his ethical model different. Some rules of just war theory, such as proportionality (anticipating the gains and losses of war, dual effects of war and the possibility of success) are unacceptable from his point of view. Nevertheless even the parallelisms and similarities in the rules and general statements don’t indicate the sameness or even similarity of contents or foundations in these two models. At least some of similarities are due to the common sources of Imam Khomeini and the just war theory.
