تحولات تاریخی شرایط قانونی و شرعی زوجین در احوال شخصیۀ ارامنۀ گریگوری ایران

ارامنۀ گریگوری ایران و دیگر مناطق جهان بر خود می بالند که در سال 301 میلادی مسیحیت در ارمنستان به دستور تیرداد سوم اشکانی (250- 330 م.)، سال‌ها قبل از دیگر کشورها، به‌عنوان دین رسمی اعلام شد و در نتیجه آیین‌ها و باورهای مسیحی در قوانین  مدنی آنان حاکم گردید. با وجود این، موقعیت جغرافیایی خاص ارمنستان و مهاجرت‌های اجباری آنان به داخل ایران و اقامت در قلمرو امپراتوری عثمانی موجب شد تحولات بسیاری در ترکیب فرهنگ، دین و قوانین آن به وجود آید به گونه‌ای که به‌رغم نسبت جمعیتی اندک از مسیحیان جهان، دارای هویت مختص خود باشند. این مقاله به بررسی تحولات تاریخی شرایط قانونی زوجین در احکام شخصیۀ ارامنۀ گریگوری ایران می‌پردازد و شرایط زوجین، از جمله دایرۀ حرمت اقارب سببی و نسبی، را در آثار کلاسیک حقوقی ارامنه جست‌وجو و مقایسه می‌کند. مهم‌ترین منابع بررسی‌شده در این مقاله عبارت‌اند از: کتاب مقدس، قوانین رسولان، سنت کلیسایی، تصمیمات شوراهای جهانی و نیز کتاب داداستان از مخیتار گُش و کتاب حقوق کلیسای ارمنیان و مقررات «احوال شخصیه» ارامنه از ملیک تانگیان. چنان‌که در مقاله دیده می‌شود ارامنه گریگوری بیشترین دایرۀ محارم را دارند.

gregory armenians of iran and other regions of the world are proud that in 301 ad christianity was declared as the official religion in armenia by order of tirdad iii parthian (250-330), years before other countries, and as a result, christian rituals and beliefs in their civil laws prevailed. despite this, the special geographical location of armenia and their forced migrations into iran and staying in the territory of the ottoman empire caused many changes in the composition of its culture, religion and laws, so that despite the small proportion of the christian population world, have their own identity. this article examines the historical developments of the legal conditions of spouses in the armenian personal decrees of gregory of iran and searches and compares the conditions of spouses, including the circle of sanctity of causal and relative relatives, in armenian legal classics.the most important sources reviewed in this article include: the holy bible, the laws of the apostles, church tradition, decisions of world councils, as well as the book of dadastan by makhitar ghosh and the book of armenian church laws and the provisions of personal status of armenians by malik tangian. as can be seen in the article, the armenians of gregory have the largest circle of incest.
