نقد شبهات دکتر سها علیه قصاص

قصاص به خاطر ارتباط آن به حیات انسان و اهمیت و حساسیت آن نیاز جدی به تبیین ابعاد مختلف دارد.پاسخ به شبهات قصاص به‌عنوان یکی از ابعاد قصاص نیاز دائم به بررسی دارد، به‌ویژه در دوره معاصر که مخالفان اسلام همچون دکترسها در رابطه با آن کتابی مستقل و حجیم «نقد قرآن» تالیف کرده‌اند. مقاله حاضر وظیفه نقد و بررسی شبهات قصاص از کتاب مذکور را برعهده دارد. در بررسی مطالب روش توصیفی تحلیلی و انتقادی و در جمع‌آوری مطالب از روش کتابخانه بهره برده شده است. برخی از شبهات قصاص که در عنوان کلی عدم تناسب بین جرم و مجازات و وجود تبعیض‌ها قرار دارند، پرداخته است. پس از بررسی به این نتیجه رسیده می‌رسیم که شبهات مذکور وارد نیستند؛ زیرا هرکدام از احکام قصاص که به‌عنوان نمونه شبهه عدم تناسب بین جرم و مجازات ذکر شدند، همچون قصاص عضو، قصاص جمعیت در برابر یک نفر، قصاص قاتل اکراه‌شده، دارای توجیه عقلانی مبنی بر رعایت عدالت و تناسب هستند. همچنین تفاوت‌های موجود در قصاص مرد و زن، مسلمان و کافر نیز بر اساس تفاوت‌های ذاتی میان افراد قابل توجیه هستند، بدون اینکه مصداق تبعیض‌های ناروا باشد

Criticism of Dr. Soha’s Suspicions against Retaliation-Punishment

Due to its relation to human life and its importance and sensitivity, retaliationpunishment needs to be explained in its different dimensions. The answer to the doubts of retaliationpunishment as one of the dimensions of retaliationpunishment needs constant investigation, especially in the contemporary period when the opponents of Islam, such as Dr. Soha, have written an independent and voluminous book “Criticism of the Quran” concerning it. This article undertakes to criticize and investigate the suspicions of retaliationpunishment from the mentioned book. Descriptiveanalytical and critical methods have been used in reviewing the materials and the library method has been used in collecting the materials. Some of the suspicions of retaliationpunishment, which are under the general title of disproportion between crime and punishment, and the existence of discrimination, have been addressed. After the investigation, we conclude that the mentioned doubts are not included; because each of the retaliationpunishment rulings that were mentioned as examples of the suspicion of disproportion between the crime and the punishment, such as the retaliationpunishment of an organ, the retaliationpunishment of a crowd against a person, the retaliationpunishment of a reluctant murderer, have a rational justification based on the observance of justice and proportionality. Also, the differences in retaliation punishment between men and women, Muslims and infidels can be justified based on the inherent differences between people, without being an example of unjust discrimination
