سازوکارهای استقرار عدالت در نظام قضائی جمهوری اسلامی ایران

بی‌تردید یکی از ارکان هر دولتی بعد از تقنین و اجرا، قضاوت است که از نظر نهادی در قوۀ قضاییه متجلی می‌شود؛ قوه‌ای که غایت و فلسفۀ وجودی آن برپایی و استقرار عدالت است. نظام جمهوری اسلامی ایران نیز نه تنها از این قاعده مستثنی نیست، بلکه از آنجایی که این دولت هم میراث‌دار سنت قدمایی فقه شیعه است و هم با بهره ‌گیری از مبانی مترقی تجدد تاسیس شده است، از همین رو، معیارهای عدالت در نظام قضایی‌اش مضاعف و دو چندان است. تا جایی که می‌توان گفت ایران از این منظر یکی از موفق‌ترین قوه‌های قضاییه در جهان امروز را تجربه می‌کند. معهذا، برخلاف واقعیتِ عدالت‌محور نظام قضایی ایران امروزه بازنمایی‌های رسانه‌ای مغرضانه‌ای از فرایند دادرسی ایران در غرب ارائه می‌شود. از همین رو، پرسش اصلی این تحقیق این است که سازوکارهای استقرار عدالت در نظام قضائی ج.ا.ا. چیست. فرضیه تحقیق بر آن بوده است که دادرسی قضایی در ایران دارای مبانی و اصولی حقوقی و قانونی مشخصی است که نه تنها در چارچوب جهان بینی اسلامی و فقه شیعه، بلکه از منظر حقوقی عرفی غربی نیز قابل دفاع است. یافته‌های تحقیق نشان داده است که اصول دادرسی منصفانه مبنای تئوری قضاوت در دستگاه قضایی ج.ا. است که این اصول در قانون اساسی، قوانین موضوعه بازتاب یافته و ریشه در متونِ وحیانی و عقلانی‌ای دارد که مبنای این قوانین قرار گرفته‌اند. رویکرد مقاله توصیفی-تحلیلی و شیوۀ جمع‌آوری داده‌ها کتابخانه‌ای و اسنادی بوده است.

undoubtedly, one of the pillars of any government, after legislation and implementation, is judgment, which is institutionally manifested in the judiciary; a force whose goal and existential philosophy is the establishment and establishment of justice. the system of the islamic republic of iran is not only not an exception to this rule, but since this government is both the inheritor of the ancient tradition of shia jurisprudence and was established using the progressive foundations of modernity, therefore, the standards of justice in its judicial system are doubled and it is double. as far as we can say, from this point of view, iran is experiencing one of the most successful judiciary in the world today. however, contrary to the justice-oriented reality of iran’s judicial system, biased media representations of iran’s judicial process are presented in the west today. therefore, the main question of this research is that the mechanisms of establishing justice in the judicial system of j.a.a. what is. the hypothesis of the research has been that judicial proceedings in iran have specific legal and legal foundations and principles that can be defended not only in the framework of islamic worldview and shiite jurisprudence, but also from the perspective of western customary law. the findings of the research have shown that the principles of fair trial are the basis of the theory of judgment in the judicial system of j.a. it is that these principles are reflected in the constitution, relevant laws and are rooted in the revelation and rational texts that are the basis of these laws. the approach of the descriptive-analytical article and the method of data collection was library and documentary.
