جایگاه امنیت مالی شهروندان در نظام فقهی و حقوقی

امنیت مالی یکی از مهم‌ترین مولفه‌های حقوق شهروندی است که تامین آن از سوی دولت یا حاکم اسلامی ضروری بوده و با مراجعه به شریعت اسلامی، قران، آیات و روایات توجه به این مسئله را به وضوح می‌توان مشاهده نمود. از این رو مقاله حاضر درصدد «بررسی جایگاه امنیت مالی شهروندان در نظام فقهی و حقوقی» است؛ سوال اصلی تحقیق این است که، جایگاه امنیت مالی در نظام فقهی و حقوقی اسلام و ایران چگونه است؟ چگونه است و به چه شیوه‌ای بر قدرت نرم جمهوری اسلامی ایران تاثیر می‌گذارد؟ فرضیه مقاله این است که، مهم‌ترین وظیفه ﺣﺎﻛﻢ در شریعت اسلام تامین امنیت مالی شهروندان از طریق اتخاذ تدابیری از جمله تعیین ﺳﻴﺎﺳﺘﻬﺎی ﻛﻠﻲ ﺻﺤﻴﺢ ﺑﺮای ﺣﻔﻆ اﻣﻨﻴﺖ اﻗﺘﺼﺎدی ﺷﻬﺮوﻧﺪان و ﭘﺎﻓﺸﺎری ﺑﺮ اﺟﺮای آن از ﻃﺮﻳﻖ ﺳﺎزوﻛﺎرﻫﺎی ﻗﺎﻧﻮنی ﺑﺮای ﻋﺪم ورود ﻟﻄﻤﻪ و ﺗﻬﺪﻳﺪ ﺑﻪ اﻣﻨﻴﺖ ﻣﺎلی می‌باشد. نتایج تحقیق نشان می‌دهد که فقه شیعه ظرفیت بسیار بالایی برای تهیه یک چارچوب حقوقی منسجم برای تضمین امنیت اقتصادی و مالی جامعه را دارد و اساساً نظام اقتصادی جمهوری اسلامی نیز به پشتوانۀ همین نظام حقوقی توانسته است قوانین امنیت مالی و اقتصادی و شرایط ثروت‌آفرینی را فراهم کند. روش تحقیق در این مقاله کیفی از نهوع توصیفی-تحلیلی است و داده ها به شیوه کتابخانه ای جمع آوری شده است.

financial security is one of the most important components of citizen’s rights, which must be provided by the government or the islamic ruler, and by referring to the islamic sharia, the qur’an, verses and traditions, attention to this issue can be clearly seen. therefore, the current article aims to &investigate the position of citizens’ financial security in the jurisprudence and legal system the main question of the research is, what is the position of financial security in islamic jurisprudence and iran? how is it and how does it affect the soft power of the islamic republic of iran? the hypothesis of the article is that the most important duty of the ruler in islamic sharia is to ensure the financial security of the citizens by adopting measures such as determining the correct general policies to protect the economic security of the citizens and insisting on its implementation through legal mechanisms to avoid damage and threats to financial security. . the results of the research show that shia jurisprudence has a very high capacity to prepare a coherent legal framework to ensure the economic and financial security of the society, and basically the economic system of the islamic republic has been able to provide financial and economic security laws and wealth creation conditions based on this legal system. slow the research method in this article is descriptive-analytical and the data was collected in a library manner.
