تاثیر اندیشه های امام خمینی (ره) بر مجازات های جایگزین در دو دهه اخیر انقلاب اسلامی

تاثیر جامعه و زمینه‌های اجتماعی در فقه، از جمله‌ مباحث کلیدی و حائز اهمیت به‌شمار می‌رود. این تاثیر در اندیشه و آرای‌ امام‌، به‌عنوان‌ شخصیتی تاثیرگذار‌، ‌‌بسیار‌ اهمیت دارد. در این مقاله تلاش شده، ابتدا چارچوب نظری بحث بر پایه خوانش امام خمینی از مفهوم مصلحت در پرتو نظریه فقه پویا و فقه حکومتی و همچنین تربیت و اصلاح به عنوان یکی از ارزش‌های مهم انقلاب اسلامی بررسی شود و در ادامه جلوه های تاثیر اندیشه امام خمینی (ره) بر مجازات ها در دو دهه اخیر انقلاب اسلامی تبیین و تحلیل شده است. نتایج تحقیق حاکی است تحت تاثیر اندیشه های امام خمینی(ره) در خصوص رعایت و توجه به مفهوم مصلحت به ویژه در زمینه قانون گذاری و توجه به مقوله اصلاح و تربیت به عنوان هدف مجازات، صورت گرفته است. امام خمینی (ره) معتقد به تاثیر و تاثر متقابل فرد و جامعه بر یکدیگر بودند و بر این اساس توجه به اصلاح و بهبود زندانیان با استفاده از روش های مختلف از جمله بهره‌گیری از مجازات های جایگزین حبس در راستای تحقق جامعه مطلوب و سالم، ضروری است.
