چکیده
|
در تحقیق حاضر، موانع و چالش‌های تولید علم و اختراع در ایران مطالعه شده و در ارتباط با موانع حقوقی، حق تولید علم و اختراع در دو کشور ایران و انگلستان مورد بررسی تطبیقی قرار گرفته است. دو سئوال اصلی مقاله این است: اولاً موانع موجود بر سر راه تولید علم و اختراع در ایران کدامها هستند؟ ثانیاً موارد مهم در ارتباط با موانع حقوقی شامل چه مواردی می‌شوند؟ بر اساس این سئوالات، دو فرضیه مطرح میشود: 1) شناخت موانع و چالش‌های تولید علم و اختراع، به راه‌های غلبه بر آنها کمک می‌کند. 2) بر خلاف شباهتهای موجود در شرایط ماهوی ثبت اختراعات، در دیگر زمینههای مطرح در بخش موانع حقوقی، تفاوتهای چشمگیری در دو نظام حقوقی ایران و انگلستان مشاهده میشود. نتیجه تحقیق نشان میدهد که برای چیرگی بر موانع و چالش‌های تولید علم و اختراع در ایران، رفع ابهام از تعاریف و مصادیق مربوط و نیز کارآمدسازی بیشتر نظام حقوقی ایرانی ضروری به نظر میرسد. روش تحقیق در این مقاله، جمعآوری دادهها به شیوهی کتابخانهای و تجزیه و تحلیل این دادههاست.

Abstract
|
in the present study, the barriers and challenges of science and invention production in iran have been studied and in relation to legal barriers, the right to produce science and invention in iran and the united kingdom has been comparatively studied. the two main questions of the article are: first, what are the obstacles to the production of science and invention in iran? secondly, what are the important issues related to legal barriers? based on these questions, two hypotheses are proposed: 1) recognizing the obstacles and challenges of science and invention production helps ways to overcome them; 2) contrary to the similarities in the substantive terms of patents, in other areas of legal barriers, significant differences are observed in the two legal systems of iran and the united kingdom. the results show that in order to overcome the obstacles and challenges of science and invention production in iran, it is necessary to remove the ambiguity of the relevant definitions and examples and also to make the iranian legal system more efficient. the research method in this article is data collection in a library method and analysis of this data.
