سازوکارهای مبارزه با جرایم تروریستی در حقوق ایران با تاکید بر امنیت ملی

امروزه تروریسم به عنوان یکی از مهم‌ترین مباحث تهدیدآمیز در سطح بین‌المللی مطرح شده و کشورهای بسیاری را با چالش امنیتی روبرو کرده است. از طرفی دیگر صیانت از ارزش های بنیادین جامعه، در قالب دکترین امنیت ملی، به ضرورتی تردیدناپذیر تبدیل شده است. بر این اساس پژوهش حاضر این سوال را مطرح می کند: سازوکارهای مقابله با جرایم تروریستی در حقوق ایران که با هدف حمایت از امنیت ملی صورت می گیرد، به چه نحوی است؟ رویکردهای حقوقی مقابله با تروریسم ایران هرچند به وضوح در قالب تروریسم بیان نشده است، اما حاکی از رویکرد دفاعی است. تفکیک مصادیق ناقض امنیت ملی به محاربه، بغی و فساد فی الارض در حقوق ایران دیده می شوند،  اما تحت عنوان جرایم تروریستی قرار نگرفته اند. با این حال، ضرورت دارد در حقوق داخلی، مصادیق تروریسم و سازوکارهای قانونی مقابله با آن تدوین و به مرحله اجرا گذاشته شود. در راه مقابله با تروریسم در داخل، برخی شرایط قانونی تحت تاثیر شرایط سیاسی، ایدئولوژیکی و ملاحظات امنیتی  قرار دارد. روش پژوهش حاضر، توصیفی-تحلیلی است که با تکیه بر منابع اسنادی انجام شده است.

mechanisms for combating terrorist crimes in iranian law with emphasis on national security

today, terrorism has emerged as one of the most important threatening issues at the international level and has faced many countries with security challenges. on the other hand, the protection of the fundamental values ​​of society, in the form of the doctrine of national security, has become an indisputable necessity. accordingly, the present study raises the question: what are the mechanisms for combating terrorist crimes in iranian law, which are aimed at protecting national security? the legal approaches to counter-terrorism in iran, although not explicitly stated in the context of terrorism, indicate a defensive approach. separation of instances of national security violations into moharebeh, fornication and corruption on earth are seen in iranian law, but are not classified as terrorist offenses. however, it is necessary to formulate and implement examples of terrorism in domestic law and legal mechanisms to combat it. in the fight against terrorism at home, some legal conditions are influenced by political, ideological and security considerations. the method of the present study is descriptive-analytical based on documentary sources.
