جایگاه اجتهاد در تحول و دگرگونی حکومت‌داری در ایران معاصر

پژوهش حاضر بررسی جایگاه اجتهاد در تحول و دگرگونی حکومت داری در ایران معاصر است. پرسشی که مطرح می شود این است که اجتهاد از چه راه هایی توانست باعث تحول و دگرگونی در عرصه حکومت داری در ایران معاصر شود؟ پاسخی که می توان ارائه کرد این است که پذیرش شکل نوینی از حکومت بر مبنای مردمسالاری دینی، ضرورت تشکیل حکومت توسط فقها، رویکرد سیاسی به مساله ولایت، و همچنین اعطای اختیارات خاص به ولی فقیه بر مبنای مصلحت و احکام حکومتی از جمله عوامل نقش آفرین اجتهاد در تحول و دگرگونی حکومت داری در ایران معاصر هستند. در پژوهش حاضر از روش توصیفی-تحلیلی استفاده شده که مطالب را از کتب و مقالات مرتبط جمع آوری نموده است. بر مبنای یافته های مطالعه حاضر، اجتهاد در نقش زیربنای تحولات سیاسی معاصر از منظر فقه سیاسی شیعه امکانات جدیدی را برای پذیرش شکل جدیدی از حکومت در قالب جمهوری اسلامی فراهم نموده است. پذیرش حق رای برای زنان، حاکمیت قانون، انتخابات، اعطای اختیارات خاص به ولی فقیه برای حب بحران های پیچیده و آنی و بهره گیری از اصل مصلحت از جمله کارویژه های اجتهاد در تغییر رویکرد حکومت داری در فقه شیعه و جامعه ایرانی و به طور مشخص دیدگاه امام خمینی(ره) است.

the present study investigates the position of ijtihad in the transformation of governance in contemporary iran. the question that arises is in what ways could ijtihad cause change and transformation in the field of governance in contemporary iran? the answer that can be provided is the acceptance of a new form of government based on religious democracy, the need for the formation of government by jurists, the political approach to the issue of governorship, as well as granting special powers to the supreme leader based on government interests and rulings. the role of ijtihad in the transformation of governance in contemporary iran. in the present study, a descriptive-analytical method has been used which has collected materials from related books and articles. based on the findings of the present study, ijtihad in the role of the basis of contemporary political developments from the perspective of shiite political jurisprudence has provided new opportunities for accepting a new form of government in the form of the islamic republic. accepting the right to vote for women, the rule of law, elections, granting special powers to the supreme leader to love complex and immediate crises and using the principle of expediency, including the characteristics of ijtihad in changing the approach to governance in shiite jurisprudence and iranian society and specifically the view of imam khomeini.
