حقوق شهروندی اسلامی در نظام جمهوری اسلامی ایران با تاکید بر قاعده احسان

حقوق شهروندی در ج.ا. ایران ریشه در قواعد فقهی، آیات و روایات دارد چرا که شهروندی در اسلام، مبتنی بر حقوق و تکالیف است و از سوی دیگر تفسیر و تحلیل قواعد فقهی را به عنوان منشا صدور احکام شهروندی در نظر می‌گیرد. از این جهت، توجه به قواعد فقهی یکی از راه های بسط و معرفی ابعاد حقوق شهروندی اسلامی است. پژوهش حاضر، ظرفیت های قاعده احسان در حوزه حقوق شهروندی را به بحث گذاشته است. یافته های پژوهش نشان می‌دهد که قاعده احسان با در نظر گرفتن خیر عمومی، مصالح جمعی، امر به معروف و نهی از منکر و همچنین مشارکت شهروندان در امور مختلف، شاکله جدیدی برای همزیستی شهروندان ایجاد می‌کند و آنان را به رقابت در حوزه های معنوی و اخلاق جمعی تشویق می نماید. بر مبنای قاعده احسان، شهروندی اسلامی، شهروندی کیفی نگر است که «توسعه انسانی» و «اخلاق جمعی» را سرلوحه کار خود قرار می‌دهد. پژوهش حاضر با روش توصیفی تحلیلی و با استفاده از متون فقهی، اسناد بالادستی و قانون اساسی به عنوان منابع اصلی انجام شده است.

Islamic citizenship rights in the system of the Islamic Republic of Iran with emphasis on the rule of benevolence

In Islamic Republic of Iran, citizenship rights refer to the rights in different fields such as justice, freedom, human dignity, rights of minorities and religions which are determined through teachings of Islam. However, Islamic citizenship rights as established in Islamic Republic of Iran are different from types of citizenship rights which are globally acknowledged. For instance, Islamic citizenship rights pays attention to both aspects of rights and liabilities. As a result, the main question of this study is “How can the rule of beneficence, as a jurisprudential rule, reinforce the aspect of citizenship responsibility and social cooperation in Islamic citizenship rights of Islamic Republic of Iran?”. As a result, this paper hypothesizes, “Beneficence rule revived the aspect of citizenship responsibility due to emphasis on altruism and social cooperation, and respecting the principle of importance”. The most significant contribution of this study supports the responsibility aspect of citizenship rights since it lifts duty off benefactor and excludes the beneficiary from the loss. In addition, beneficence rule encourages responsible citizenship since it offers legal support of altruistic citizens. It adopts a descriptiveanalytical methodology and library reviewing method so as to review previous papers and studies and collect data on the field.
