بررسی حکم زکات در ملک متزلزل

در فقه امامیه برای وجوب زکات بر یک فرد در یک مال زکوی، شرایط متعددی شمرده شده است، برخی از آن شرایط به خود مکلف و برخی دیگر به مال برمی­گردد؛ در خصوص مال، در ملکیت فرد بودن، شرط است، اما در برخی موارد مالکیت فرد متزلزل بوده و با تحقق عواملی از بین می­رود؛ مانند مالکیت زوجه بر مهر قبل از دخول یا مالکیت مشتری بر مبیع در زمان خیار بایع. فقها بدون تبیین دقیق مفهوم تزلزل ملکیت و بررسی مدخلیت آن در حکم مساله؛ تنها به بحث زکات در برخی از مصادیق ملک متزلزل پرداخته­اند. از تتبع در ادله و عبارات فقها و تحلیل آنها می­توان نتیجه گرفت که ملک متزلزل مفهومی غیر از عدم تمامیت ملک و عدم تمکن از تصرف بوده، و از حیث دخالت داشتن در حکم مساله لازم است در هریک از مصادیق آن، حصول ملکیت و تمکن از تصرف مورد تحلیل قرار گیرد.

Research on the Ruling of Zakāt in NonDeployed Property

For the incumbency of zakāt on a person for a property, several conditions are taken into consideration in Shi’ite jurisprudence, some of which are obliged to the owner of property and others concern to property. For property, being owned by the person is necessary but in some cases, individual ownership has been nondeployed and with the realization of some elements it disappears; such as the wife's ownership of dowry before consummation or customer’s ownership over the object of sale at the time of put option. Jurists, without a clearly articulation of nondeploying of ownership and review of its interference with the ruling, have only discussed on zakāt in some instances of nondeployed property. With assessment of the reasons and statements of the jurists and their analysis it can be concluded that nondeployed property is a concept beyond lack of integrity of the property and noncompliance of capture in terms of involvement in the ruling of the issue; and it is necessary to analyze each of those instances in gaining ownership and power on capture.
