مبانی فقهی جرم‌انگاریِ نقض سوگند غیرقضایی

سوگند غیرقضایی (سوگند عهدی)، نوعی قسم بر تعهد به انجام یا ترک اعمال (انجام ماموریت و وظیفه با شرایط مشخص و به گونه بایسته و شایسته) است. برای ورود به مسئولیت‌های مهمی مانند ریاست جمهوری و نمایندگی مجلس، این سوگند بایسته است. اهمیت این مشاغل از یک‌سو و جایگاه سوگند (به دلیل حاکمیت و محوریت ارزش‌های دینی اسلامی) از دیگر سو، برجستگی این نوع قسم را بیشتر می‌کند. آن توجه و این جایگاه، ناقض این سوگند را در نگاه شرع مقدس، مستوجب کفاره می‌کند. اما افزون بر کفاره شرعی، برای جایگاه و ضمانت اجرای آن، رویکرد و نهاد خاصی در قانون به چشم نمی‌خورد. این جُستار با ابتنای بر برخی مبانی از قبیل وجوب موکد شرعی وفای به عهد و عقد (مستند به آیات و روایات)، قواعد فقهی، ناروایی و عدم جواز سلب اعتماد عمومی، قاعده حفظ نظام و نیز اقتضای آمره بودن وفای به عهد و عقد، بر این باور است که لزوم جرم‌انگاریِ حنث و نقض سوگند غیرقضایی (سوگند عهدی)، بسیار مدلل و موجه است.

Jurisprudential Principles of Criminalization of the Violation of Nonjudicial Oath

.To enter important responsibilities, such as the presidency, the parliament, an oath is referred to as a nonjudicial oath. The importance of these occupations, as well as the status of the oath (due attention to religiousIslamic values), increase the prominence of this category. That consideration and this position, deems the violator of this oath as deserving atonement. But in addition to the religious atonement, for the guarantee of its implementation, there is silence that reveals the importance of research thereby. This inquiry is based on some principles such as the obligation of religious emphasis on fulfilling the covenant (based on Qur’anic verses and hadiths), jurisprudential rules (such as la zarar), inadmissibility of deprivation of public trust, the rule of maintaining order and the necessity of being a dictator. Faithfulness in the covenant and contract, maintains that the need for criminalization and violation of the judicial oath, is very justified and wellreasoned.
