امکان‌سنجی فقهی – حقوقی نقل اختیاری حق قصاص

از آنجا که قصاص حقی غیر مالی است، و هر حقی دارای آثار متفاوتی از جمله استیفاء، اسقاط، انتقال، نقل و ... می‌باشد، سخن گفتن از امکان تحقق یا عدم تحقق نقل حق قصاص، سوال اصلی این مقاله است. این که صاحبان حق قصاص، امکان متجلی ساختن کلیه آثار حق را دارند، و یا این که تنها می‌توانند به استیفای قصاص بپردازند، امری است که نیازمند تحقیق و بررسی است. بسیاری از منابع فقهی و حقوقی، در خصوص توسعه اختیارات اولیای‌د‌‌‌م در قالب انتقال حق قصاص، آن را در زمره اختیارات اولیای‌دم برنشمرده‌اند، در حالی که برخی از این منابع به‌‌طور ضمنی قائل به صحت و امکان آن شده‌ا‌ند. با تحقیق و بررسی در خصوص قابلیت انتقال می‌توان به این امر واقف شد. از آنجاکه موجب حق قصاص به نحو اقتضائی است و قوام آن به اولیای‌دم نیست، برخی از آثار حق مانند قابلیت نقل و انتقال بر آن مترتب می‌شود.

Legal and Jurisprudential Feasibility of Transferring the Right of Retribution (Qiṣāṣ)

Since retribution is a nonfinancial right, and each right has different effects such as resignation, abrogation, transfer, etc., talking about the possibility of realization or nonrealization of transferring the right of retribution is the main question of this article. That the claimants of the right of retribution have the opportunity to manifest all the effects of the right or they can only seek retribution is something that needs research.Many jurisprudential and legal sources regarding the development of the authority in the form of transferring of the right of retribution have not considered it as among their authority, whereas some of these sources have implicitly considered its possibility. By researching and examining the transferability, it can be realized that since it causes the right of retribution in a contingent manner and its consistency is not dependent upon the claimant of blood, some effects of the right, such as transferability, are entailed thereby.
