تحلیل حق اولیای دم در فرض کشته شدن عمدی قاتل

قصاص در برابر جنایت عمدی حق مجنی علیه و یا اولیاء دم می‌باشد، اما ممکن است قبل از استیفای آن حق، جانی توسط دیگری کشته شود. در این فرض احقاق حق اولیاء دم چگونه خواهد بود؟ آیا در صورت عمدی بودن قتل، قصاص قاتل یا اخذ دیه و یا حتی عفو در اختیار اولیاء مقتول اول خواهد بود؟ این پژوهش که به روش توصیفی تحلیلی انجام‌گرفته نشان می‌دهد که اولاً: در خصوص این فرض قانون ساکت بوده و در کتب فقهی نیز به‌صراحت به آن پرداخته نشده‌است؛ لذا نیازمند تحلیل و بررسی است. ثانیاً: با عنایت بر این‌که تقدم بر استحقاق حق، مقدم بر تقدم استیلاء حق محسوب می‌شود، لذا شرعاً اعمال حق توسط اولیاء مقتول اول رجحان بیشتری دارد. بنابراین با توجه به تقدم استحقاق حق، به نظر می‌رسد قصاص یا عفو و نیز تبدیل‌شدن قصاص به دیه در حیطه اختیارات اولیاء دم اول باشد.

This research, which has been done by descriptiveanalytical method, shows that firstly: the law is silent about this assumption and it has not been explicitly addressed in jurisprudential books, so it needs to be analyzed. secondly: Considering that the precedence over the entitlement of the right is considered prior to the precedence of the domination of the right, therefore the exercise of the right by the parents of the first victim is more preferable. Therefore, considering the priority of entitlement to the right, it seems that retribution or amnesty, as well as the conversion of retribution into blood money, is within the authority of the firstdegree parents.
