حق فرزندخواهی زوجین از یکدیگر از منظر فقه امامیه

یکی از مسائل پرچالش حوزه‌ی فقه و حقوق خانواده،‌ مساله‌ی فرزندآوری و حق مطالبه‌ی آن برای زوجین است. مساله­ی مذکور در میان قدما و متاخرین مورد بحث قرار نگرفته‌است؛ در مقابل، به‌صراحت در کتاب­های فقه فتوایی معاصرین مشاهده می‌شود. عدم بررسی استدلالی مساله از سوی فقیهان، علاوه بر اعتقاد به ناکافی بودن پژوهش‌های فقهی در این زمینه، ضرورت بحث را توجیه می‌نماید. این نوشته به روش تحلیلی و استدلالی صورت گرفته ‌است و‌ براساس جمع عرفی روایات باب عزل،‌ در کنار دیدگاه‌های سه‌گانه‌ی موجود از مراجع، دیدگاه چهارمی با عنوان «تقدم حق هر یک از زوجین که طالب فرزند باشد» اختیار نموده است. در نهایت این نتیجه با اقتضای معاشرت به معروف تایید شده است.

The Right to Demand a Child in The Family From the Perspective of Imamiyeh Jurisprudence

One of the most challenging issues in the field of jurisprudence and family law is childbearing and the right to demand child for couples. This issue has not been discussed among the ancients and the later scholars; in contrast, the fatwas of contemporaries have explicitly seen in the books of jurisprudence. The lack of argumentative study on the issue by jurists, in addition to believe in the inadequacy of the jurisprudential research in this field, justifies the need for discussion. This article has been done analytically and argumentatively in accordance to the customary collection of narrations on the subject to dismissal. Additionally, to the three existing views of the authorities, this article has adopted a fourth view entitled Priority of the right of each couple who seeks a child. Last but not least, the result has been confirmed by the necessity of associating with the famous.
