نقش عقل در فهم شریعت و قانونگذاری

عقل عملی کاربردهای فراوانی در مباحث اصولی دارد، اما با توجه به هدف علم اصول و مقدمه بودن آن برای فقه، صرفاً از یکی از کاربردهای عقل یعنی عقل مشرِّع سخن به میان آمده و ضوابط و لوازم آن مطرح‌شده است. درحالی‌که به اذعان برخی از علماء، کارکرد این درک عقل در علم فقه، نادر است و این کاربرد ناچیز، موجب کم‌اهمیت شدن مبحث عقل در بین مسائل علم اصول شده است درحالی‌که کارکرد عقل در سامان دادن به مسائل اصولی و تنظیم رابطه قانون‌گذار و مکلف، بسیار بااهمیت و البته دارای ضوابط و قواعد مختص به خود است. این مقاله بر آن است که با روش توصیفی تحلیلی، ساختاری از عقل را با توجه به ظروفی که عقل در آن به ادراک می‌پردازد، ارائه دهد و ضوابط و قواعد هرکدام را بیان نماید.

The Role of Intellect in Understanding Shariah and Legislation

Practical Intellect has many functions in Usul alFiqh (Principles of Jurisprudence), however, considering the purpose of Usul and its status as an introduction to Fiqh (the science of Islamic Jurisprudence), merely[PB1] [PB2]  one of the functions of intellect, i.e. legislative intellect, and its criteria has been discussed. While acknowledged by some scholars, the function of this kind of intellect in jurisprudence is rare, which leads to disparaging intellectual topics in Usul; the function of intellect in organizing the topics of Usul and regulating the relationship between the legislator and people is of great importance, although this requires its own rules and regulations. Having[PB3] [PB4]  a descriptiveanalytical approach, this article tries to introduce a structure of intellect according to the circumstances in which it conceives, and also the rules and regulations of each circumstance.
