مفهوم حق و آزادی در اندیشۀ «طالبوف»

مشروطیت ایران به عنوان حادثه مهم دوران جدید ایران باعث ورود بسیاری از مفاهیم جدید در اندیشه ایرانیان شد. مفهوم حق، یکی از مفاهیم مهمی بود که متفکران این عصر مطرح کردند. روشن فکران در طرح این مفاهیم، نقش عمده‌ای داشتند. آنها توانستند ایرانیان را با بسیاری از مفاهیم دوران جدید همچون قانون، پارلمان، تحدید قدرت، آزادی، برابری، قانون اساسی و... جدید آشنا کنند. درباره مفهوم حق، سخنان یکی از روشن فکران یعنی «طالبوف تبریزی»، دقیق تر از دیگران است. او با مفهوم حق به معنای مدرن آشنا بود. از این رو طرح دقیقی از مفهوم حق طراحی می‌کند و در آن به مبنای حق، انواع حق، تجاوز به حق و تزاحم حق‌ها می‌پردازد. طالبوف همچنین آزادی را به عنوان یکی از مصادیق حق مطرح کرده، کوشش می‌کند تا برای این خواسته مهم مشروطیت ایران، مبانی نظری بیابد. تعریف و ستایش او از آزادی، پیوند آن با حق، تعیین حدود آزادی و تاکید بر اجتناب از هرج ومرج از جمله تاکیدات اوست. این مقاله با تکیه بر آثار طالبوف و با روش توصیفی تحلیلی به دنبال بررسی این پرسش است که حق در اندیشه طالبوف چه جایگاهی دارد و به چه معنایی است و چه نسبتی با آزادی دارد و کوشش شده است تا نظریه او در باب حق و آزادی به عنوان دو مفهوم کلیدی در مشروطیت ایران توضیح داده شود.

The Concept of Right and Freedom in Talibov's Thought

Iranian Constitutionalism as an important event of the Iranian new Ages introduces many new concepts to Iranian thought. The concept of right as well as the concept of freedom as two important concepts were put forward by the thinkers of this age and theorized about it. Intellectuals, as one of the groups involved, played a major role in designing these concepts. They were able to acquaint Iranians with many concepts of the new era, such as law, parliament, limitation of power, freedom, equality, constitution, and so on. Talibov Tabrizi's words about the concept of right are more precise than others. Talibov's life outside of Iran and his familiarity with the writings of Western scholars have led him to carefully examine new concepts. He has spoken precisely about many modern concepts. He deals with the basis of law, types of rights, violations of rights, and conflicts of rights. It also calls for freedom as one of the evidences of right and tries to find theoretical foundations for this important demand of Iranian constitutionalism. He has the emphasis on praising freedom, linking it with the right, setting limits on freedom, and the avoidance of chaos. Relying on Talibov's works and using a descriptiveanalytical method, this article seeks to examine the question of what is the place and meaning of right in Talibov's thought and what is its relation to freedom. And an attempt has been made to explain his theory of rights and freedoms as two key concepts in Iranian constitutionalism.
