استاندارد مطلوب دادرسی دعاوی حقوقی در بازار سرمایه

دادرسی در بازار سرمایه همچون دادرسی‌های مدنی، با هدف حل‌وفصل اختلافات مدنی و با محوریت تامین منافع خصوصی است؛ با این تفاوت که در حوزه بازار سرمایه، مصالحی فراتر از مصالح شخصی بلکه ناظر بر منافع عمومی و اقتصادی کشور نیز مطرح می‌شود. اطمینان به وجود سیستم دادرسی عادلانه و کارآمد یکی از عوامل رونق و توسعه‌ی بازار سرمایه از طریق کاهش ریسک سرمایه‌گذاری، ترغیب به سرمایه‌گذاری بیشتر و جذب سرمایه می‌باشد. کارایی دادرسی ریشه در میزان مطلوبیت آن نزد سرمایه‌گذاران دارد. انصاف، سرعت و تخصص در دادرسی‌های بازار سرمایه از مهم‌ترین معیارهای مطلوبیت دادرسی از منظر سرمایه‌گذاران است.هم راستایی با مصالح و اقتضائات خاص دادرسی در بازار سرمایه (سرعت و تخصص) با عدول از برخی اصول کلی دادرسی عادلانه محقق خواهد شد، ضمن آنکه اصول ثابت و مسلم دادرسی بایستی تمام و کمال اعمال شوند. پژوهش حاضر با روش توصیفی تحلیلی درصدد شناسایی و ارزیابی اصول یاد شده است.

the goal of capital market dispute resolution system is legal claims resolution with a focus on securing private interests, like civil litigation. the difference is that there are public and economic interests of the country in addition to private interests in the capital market.ensuring a fair and efficient dispute resolution system is one of the factors for capital market prosperity by reducing investment risk and encouraging more investment. the efficiency of dispute resolution system is rooted in its desirability for investors. fairness, speed, and expertise in dispute resolution system are the most important criteria for the desirability of dispute resolution system from the perspective of investors.alignment with the special interests and necessities of capital market dispute resolution system (speed and expertise) will be achieved by deviating from some principles of dispute resolution system, while the invariable and definite principles of dispute resolution must be completely applied. the present research seeks to identify and evaluate the mentioned principles by the descriptive analytical method.
