بازشناخت بایستگی‌ها و کارکردهای مطالعات میان‌رشته‌ای: مفاهیم حقوقی و ادبی

امروزه در نظام آموزش عالی، مطالعات میان‌رشته‌ای جایگاهی درخور توجه یافته است و به نیازی اساسی در محیط‌های دانشگاهی و در فرایند تولید علم تبدیل شده که افزون بر گستراندنِ دانش‌های گوناگون و کاربرد ظرفیت‌های رشته‌های هم‌جوار، موجب گشوده‌شدن مرزهای جدید در حوزه‌های دانش‌پژوهی، پاسخ‌گویی به حل مسائل چندوجهی و نیز دورشدن از بحران‌های ناشی از تک‌رشته‌ای می‌شود. از این منظر، نگاه به قابلیت‌های پیدا و پنهان دو حوزۀ مطالعات حقوقی و مطالعات ادبی و بهره‌بردن از سازوکارهای علمی هریک از آن‌ها، می‌تواند زمینه‌ای فراهم کند تا پژوهشگران این دو حوزه را در رهیافت‌های جدید علمی و رفع نیازهای جوامع بشری یاری رساند. این مقاله که به روش کتابخانه‌ای و تحلیل داده‌ها به‌صورت کیفی انجام شده، دستاوردش این است که مطالعات میان‌رشته‌ای ادبیات و حقوق، ضرورتی اجتماعی و دانشگاهی است و نتایج آن می‌تواند در دو قلمرو ادبیات و حقوق، در پی‌ریزی سیاست‌های اجتماعی، گسترش سطح عقلانیت و عدالت اجتماعی در جامعه، کشف قلمروهای جدید فکری، واکاوی و شناخت خطاهای طرفداران این دو حوزۀ علمی، بالابردن سطح انعطاف‌پذیری پژوهشگران، زدوده‌شدن شکاف‌های ارتباطی بین متخصصان این دو، موثر باشد.

Recognizing the requirements and functions of interdisciplinary studies of legal and literary concepts.

In the contemporary higher education system, interdisciplinary studies has gained a prominent place and has become a basic need in academia and in the process of science production, which in addition to expanding knowledge and using the capacities of neighboring disciplines, opens up new frontiers in the field of research, responds to solving multifaceted problems as well as avoiding crises caused by a single discipline. The purpose of this study is that looking at the visible and hidden capabilities of the two fields of legal studies and literary studies and using the scientific mechanisms of each of them, can provide a basis for researchers in these two fields to help in new scientific approaches and meet the needs of human societies. The findings of the present study, which is based on a librarybased methodology and qualitative data analysis, is that interdisciplinary studies in literature and law are a social and academic necessity, and the results can be used in both the realms of literature and law. They can also be effective in spreading the level of rationality and social justice, discovering new intellectual realms, analyzing and recognizing the mistakes of the proponents of these two scientific fields, raising the level of flexibility of researchers, closing the communication gaps between the two experts.
