حق محبوسین بر فرار از زندان به جهت پاندمی ویروس کرونا و حق دولت در مقابله با زندانیان فراری از منظر فلسفه سیاسی هابز

شیوع ویروس کرونا در سال‌های 2020-2019 میلادی جنبه‌های مختلف زندگی انسانی را اعم‌از آموزش و تجارت و اقتصاد و فرهنگ و پزشکی و به تبع آن، اندیشه‌های زیربنایی را در منصهٔ تحلیل دوباره قرار داد. فلسفهٔ عدالت کیفری نیز از این امر مستثنی نیست. با فرار زندانیان در اوایل سال جاری از زندان‌های کشور به‌دلیل پاندمی کرونا، بحث جدیدی درخصوص تحلیل مبنای حق بر فرار محکوم از کیفر و به تبع آن حق دولت بر مقابله با مجرم فراری از زندان به‌مثابهٔ شهروند و یا دشمن ایجاد شد. این پرسش که آیا محکومی که بیم خطر جانی خود را در زندان می‌دهد، از نظر فلسفی، حق دارد از زندان فرار نماید و آیا باید این حق برای وی به رسمیت شناخته شود؟ آیا دولت حق دارد در شرایط پاندمی و در صورت فرار با او چون یک دشمن برخورد نماید؟ مسئلهٔ این مقاله موضوعی بین‌رشته‌ای حقوق کیفری و فلسفه می‌باشد. مقاله به تحلیل این موضوع با محوریت فلسفهٔ سیاسی هابز به‌عنوان فیلسوفی می‌پردازد که اگرچه به حق دولت بر کیفر تاکید کرده اما بر حق مجرم بر مقاومت در برابر کیفر نیز اصرار ورزیده و در ظاهر نوعی تعارض درونی در اندیشهٔ وی در این زمینه وجود دارد. براساس یافته‌های این مقاله، محبوسین حق فرار از زندان را در شرایط پاندمی کرونا نه در معنای «حق/ادعا» بلکه در معنای «حق/امتیاز» داشته و دولت حق مقابله با آنان را به‌مثابهٔ «شهروند» در مفهوم «حق/قدرت» دارد.

the right of prisoners to run away from jails and the right of governments to confront with them in the corona pandemic situation in the light of hobbes political philosophy

the pandemic of coronavirus in 201920 influenced different aspects of human beings’ lives such as education, business, economy, culture, medical care, and consequently their fundamental thoughts were the subjects to be revised. philosophy of criminal justice was not an exception. since many inmates escaped from multi jails in iran in this period, the philosophy of law faced the heated widespread debates on the right of internee to get out and the right of the government to confront with them as a citizen or enemy. the question was this: due to the fear of the coronavirus and the death, if the prisoners have the right to flee and if the government has the right to oppose them. if yes, what are the foundations of their rights? the paper scrutinizes these issues in the light of thomas hobbes’s political philosophy because he insisted on the right of government on the one hand and the criminal’s rights to resist punishment on the other hand. finally, the paper concludes that the prisoners have the right to run away in the corona pandemic situation, but their rights should be interpreted in the meaning of right/privilege, not right/claim; and governments have the right to oppose them in the meaning of right/power.
